Common use of SCOPE OF DELIVERY Clause in Contracts

SCOPE OF DELIVERY. FIRM GAS, PRIORITY-OF-SERVICE CATEGORY 2 Xxxxx agrees to purchase from Seller, and Xxxxxx agrees to sell to Buyer, up to the Maximum Daily Quantity of natural gas which shall not be subject to interruption or curtailment except for conditions as set forth in Article IV, Paragraph 3, of the General Terms and Conditions hereto attached. The Maximum Daily Quantity of Firm Gas shall be 115 dekatherms per day. Any gas taken by Buyer above the Maximum Daily Quantity, after notice from Seller of curtailment to the Maximum Daily Quantity, without Seller's advance approval, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 5, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Firm Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of-Service Category 2 as set forth in Article III, Paragraph 1, of the General Telxns and Conditions hereto attached. SCOPE OF DELIVERY. FIRM (A) INTERRUPTIBLE GAS, PRIORITY-OF-SERVICE CATEGORY 2 3D Seller acknowledges that Buyer may utilize a source of gas other than system supply gas from Seller's sources. Xxxxx's gas may be transported to Buyer by Seller upon execution of a Transportation Agreement between Xxxxx and Seller. Natural gas is provided hereunder to satisfy Buyer's requirements when Seller is not providing transportation services. Xxxxx agrees to purchase from Seller, and Xxxxxx agrees to sell to Buyer, up to the a Maximum Daily Quantity of 1040 dekatherms of natural gas which shall not per day on an interruptible basis, to be subject purchased and utilized by Xxxxx when and to interruption or curtailment except the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for conditions as fuel. Seller makes no guarantee of deliveries hereunder. Interruptible gas will be offered when, and to the extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 34, of the General Terms and Conditions to Industrial Service Agreements hereto attached. The Maximum Daily Quantity of Firm Gas shall be 115 dekatherms per day. Any gas taken by Buyer above the Maximum Daily QuantityBuyer, including gas utilized as fuel for pilots, after notice from any order of Seller calling for complete curtailment of Buyer's interruptible load, or any gas taken by Buyer in excess of a partial curtailment to the Maximum Daily Quantity, without Seller's advance approvalorder, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 56, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Firm Interruptible Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of-Service Category 2 3D as set forth in Article III, Paragraph 1, of the General Telxns Terms and Conditions hereto attached. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or manually operated flow control valves so as to limit the hourly flow of gas within the specified quantity. ° POINT OF DELIVERY The Point of Delivery for all gas delivered hereunder shall be at the outlet side of Seller's measuring and regulating equipment. The measuring equipment shall be installed on the Buyer's property at a location mutually agreed upon by Xxxxxx and Buyer. All gas shall be delivered at this location and it shall be the Buyer's responsibility to extend all fuel lines from this location to the point or points of usage. . DELIVERY PRESSURE Xxxxxx agrees to use due care and diligence to furnish gas hereunder at such uniform pressure as Seller may elect up to, but not exceeding 20 pounds per square inch gauge, and not less than 5 pounds per square inch gauge, at the "Point of Delivery". Buyer shall be responsible for the installation and operation of adequate safety equipment downstream of the Point of Delivery so as to relieve or control pressure variations within the limits described above that may, for any reason through malfunction of Seller's equipment or otherwise, occur on Buyer's side of the "Delivery Point".

Any gas taken by Buyer above the Maximum Daily Quantity, after notice from Seller of curtailment to the Maximum Daily Quantity, without at Seller's advance approvaldelivery point from SCPC located near Sumter, shall be Unauthorized Overrun Gas South Carolina, and shall subject Buyer to the penalty rate per dekatherm set forth transport Buyer's gas and redeliver to Buyer. Service provided hereunder is in Article IV, Paragraph 5, lieu of the General Terms and Conditions natural gas provided from Seller's system supply to Industrial Service Agreements hereto attached. Deliveries of Firm Gas under this paragraph of the Service Agreement shall be utilized by Buyer only satisfy Buyer's fuel requirements in Priority-of-Service Category 2 as set forth in Article III3D. Buyer agrees that the transportation service is provided on an interruptible basis. Interruptions of transportation service shall be at the sole discretion of Seller or whenever service is interrupted by SCPC or any other transporting pipeline. , Paragraph 1DAILY DELIVERIES Seller agrees to accept and transport up to dekatherms, excluding shrinkage volumes, of the General Telxns and Conditions hereto attachednatural gas on a daily basis. Buyer shall purchase all gas tendered will notify Seller, in writing, of Buyer's intent to transport on Seller's Form CA1, at least five (5) working days prior to the beginningof anymonth andwill provide theestimatedvolumesof gas,in dekatherms, to be transportedon adaily basisduring thecalendarmonth. Buyer hastheright to changethe volumeto betransportedduring themonthon adaily basis. It is Buyer'sresponsibilityto notify producers,Seller,andconnectingpipelines regardingany changein transportationvolumes. Sellerwill acceptchangesin daily volumesdispatchedfrom SCPC;however,Sellerreservesthe right to limit or restrict the volumesacceptedandtransportedat any time, whenever,in Seller'ssole opinion, operatingconditionswarranta limitation or restrictionon the acceptanceor delivery of transportationgas. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or manually operated flow control valves so as to limit the hourly flow of gas within the specified quantity.

SCOPE OF DELIVERY. FIRM INYERRUPTIBLE GAS, PRIORITY-OF-SERVICE CATEGORY 2 6 Xxxxx agrees to purchase from Seller, and Xxxxxx agrees to sell to Buyer, up to the a Maximum Daily Quantity of 800 dekatherms of natural gas which shall not per day on an interruptible basis, to be subject purchased and utilized by Buyer when and to interruption or curtailment except the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for conditions as fuel. Seller makes no guarantee of deliveries hereunder. Interruptible gas will be offered when, arLd to the extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 34, of the General Terms and Conditions to Industrial Service Agreements hereto attached. The Maximum Daily Quantity of Firm Gas shall be 115 dekatherms per day. Any gas taken by Buyer above the Maximum Daily QuantityBuyer, including gas utilized as fuel for pilots, after notice from any order of Seller calling for complete curtailment of Buyer's interruptible load, or any gas taken by Buyer in excess of a partial curtailment to the Maximum Daily Quantity, without Seller's advance approvalorder, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 56, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Firm Interruptible Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of-Service Category 2 of- ServiceCategory6 as set forth in Article III, Paragraph 1, of the General Telxns Terms and Conditions hereto attached. SCOPE OF DELIVERY. FIRM GAS, PRIORITY-OF-SERVICE CATEGORY 2 Xxxxx Seller agrees to purchase accept deliveries of natural gas belonging to Buyer at any of Seller's delivery points from Transco or Southern and to transport Buyer's gas and redeliver to LDC at Effingham, South Carolina. Buyer agrees that the transportation service is provided on an interruptible basis. Interruptions shall be at the sole discretion of Seller or whenever service is interrupted by an interstate supplier. Seller is expected to exercise the ordinary and reasonable standards of the gas industry in regard to interruptions. Buyer hereby certifies that Buyer and LDC have entered into a Transportation Agreement whereby LDC will accept Buyer's gas from Seller. Buyer hereby agrees to make copies of this Interruptible Transportation Agreement available to Seller upon Seller's request. Buyer agrees to notify Seller of any and all amendments, modifications, changes, cancellations, or extensions of any kind whatsoever of the Transportation Agreement between Buyer and LDC. , DAILY DELIVERIES Seller agrees to accept and transport up to 925 dekatherms, excluding shrinkage volumes, of natural gas on a daily basis. Buyer shall notify Seller of Buyer's intent to transport at least five (5) days prior to the beginning of any month and will provide the estimated volumes of gas in dekatherms to be transported on a daily basis during the next calendar month. Buyer has the fight to change the volume to be transported during the month on a daily basis. It is Buyer's responsibility to notify producers, Seller, and Xxxxxx agrees to sell to Buyerconnecting pipelines regarding any change in transportation volumes. Seller will accept changes in daily volumes dispatched from either Southern or Transco; however, up to the Maximum Daily Quantity of natural gas which shall not be subject to interruption or curtailment except for conditions as set forth in Article IV, Paragraph 3, of the General Terms and Conditions hereto attached. The Maximum Daily Quantity of Firm Gas shall be 115 dekatherms per day. Any gas taken by Buyer above the Maximum Daily Quantity, after notice from Seller of curtailment to the Maximum Daily Quantity, without Seller's advance approval, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 5, of the General Terms and Conditions to Industrial Service Agreements hereto attached. All gas shall be delivered at this location and it shall be the Buyer's responsibility to extend all fuel lines from this location to the point or points of usage. . DELIVERY PRESSURE Seller agrees to use due care and diligence to furnish gas hereunder at such uniform pressure as Seller may elect up to, but not exceeding 15 pounds per square inch gauge, and not less than 5 pounds per square inch gauge, at the "Point of Delivery". Buyer shall be responsible for the installation and operation of adequate safety equipment downstream of the Point of Delivery so as to relieve or control pressure variations within the limits described above that may, for any reason through malfunction of Seller's equipment or otherwise, occur on Buyer's side of the "Delivery Point".
