SECURITY FOR PERFORMANCE OF TENANT'S OBLIGATIONS. Notwithstanding any security deposit held by Landlord pursuant to Section 5, Tenant hereby agrees that in the event of a default by Tenant, Landlord shall be entitled to seek and obtain a writ of attachment and/or a temporary protective order and Tenant hereby waives any rights or defenses to contest such a writ of attachment and/or temporary protective order on the basis of California Code of Civil Procedure Section 483.010 or any other related statute or rule.
SECURITY FOR PERFORMANCE OF TENANT'S OBLIGATIONS. Notwithstanding any security deposit held by Landlord pursuant to Section 5 and any security interest held by Landlord pursuant to Section 58, Tenant hereby agrees that in the event of a default by Tenant, Landlord shall be entitled to seek and obtain a writ of attachment and/or a temporary protective order.
SECURITY FOR PERFORMANCE OF TENANT'S OBLIGATIONS.
21.1 As security for the performance of its obligations under this Lease, on or before the Lease Term Commencement Date, Tenant shall execute and deliver to Landlord a security agreement in a form and content reasonably acceptable to Landlord (the "Security Agreement"), pursuant to which Tenant shall pledge as security for the performance of Tenant's obligations arising hereunder, any and all contracts, licenses, permits and other intangible assets related to the use and operation of the Coliseum, in each case to the extent Tenant may do so without being in default or breach under the contract, license, permit or other intangible asset in question and subject to the rights of each Leasehold Lender (as defined in Schedule J).

Notwithstanding any Security Deposit held by Landlord pursuant to Section 5 and any security interest held by Landlord pursuant to Section 57, Tenant hereby agrees that in the event of a default by Tenant, Landlord shall be entitled to seek and obtain a writ of attachment and/or a temporary protective order and Tenant hereby waives any rights or defenses to contest such a writ of attachment and/or temporary protective order on the basis of the State of Maryland Code of Civil Procedure or any other related statute or rule.

Notwithstanding any security deposit held by Landlord pursuant to Section 5 and any security interest held by Landlord pursuant to Section 57, Tenant hereby agrees that in the event of a default by Tenant, Landlord shall be entitled to seek and obtain a writ of attachment and/or a temporary protective order and Tenant hereby waives any rights or defenses to contest such a writ of attachment and/or temporary protective order on the basis of the State of New Jersey Code of Civil Procedure or any other related statute or rule.
SECURITY FOR PERFORMANCE OF TENANT'S OBLIGATIONS. 21.1 The Parties acknowledge and agree that, prior to the Lease Effective Date, as security for the performance of its obligations under this Lease, Tenant deposited with Landlord Five Million Dollars ($5,000,000) as security deposit for Xxxxxx's full, faithful and timely performance of Xxxxxx's obligations hereunder (the "Security Deposit"). If (i) Tenant fails to pay rent or any portion thereof or any other charge(s) due hereunder, or (ii) is otherwise in an event of uncured breach or default with respect to any provision of this Lease beyond the applicable cure period, if any, then Landlord may (but is not obligated to) use, apply or retain all or any portion of the Security Deposit towards the same; pay any other sum to which Landlord may become obligated by reason thereof; compensate itself for any loss, damage or injury which Landlord may suffer thereby; or otherwise apply all or any portion of the same to other costs and expenses incurred by Landlord not inconsistent with the provisions of this Lease. If Landlord so uses or applies all or any portion of the Security Deposit, Tenant shall within ten (10) calendar days after written demand therefor deposit cash with Landlord in an amount sufficient to restore said deposit to at least the amount originally required hereunder. If Tenant timely, fully and faithfully performs all of Tenant's obligations hereunder, the Security Deposit or so much thereof then remaining shall be returned, without payment of interest or other increment for its use, to Tenant upon the expiration of the Lease Term and, in all events, only after Xxxxxx has vacated the Premises and turned over possession of the same to Landlord in accordance with the provisions of this Lease. No trust or other relationship is created herein between Landlord and Tenant with respect to said Security Deposit, and Landlord shall not be required to keep the Security Deposit separate from its general or other accounts or otherwise to account to Tenant with respect thereto at any time. Landlord may increase the Security Deposit at times and from time to time during the Term hereof in accordance with the CPI Index, although no more frequently than once every five (5) Lease Years, and Xxxxxx agrees to deposit the amount of the increase with Landlord within thirty (30) calendar days of Landlord's notice setting forth the increased Security Deposit amount.

Notwithstanding any security deposit held by Landlord pursuant to Article 31.27, Tenant hereby agrees that in the event of a default by Tenant, Landlord shall be entitled to seek and obtain a writ of attachment and/or a temporary protective order and Tenant of attachment and/or temporary protective order on the basis of the Commonwealth of Massachusetts Code of Civil Procedure or any other related statute or rule.
SECURITY FOR PERFORMANCE OF TENANT'S OBLIGATIONS. Notwithstanding any security deposit held by Landlord pursuant to Article 20, Tenant hereby agrees that in the event of a default by Tenant, Landlord shall be entitled to seek and obtain a writ of attachment and/or a temporary protective order and Tenant hereby waives any rights or defenses to contest such a writ of attachment and/or temporary protective order on the basis of California Code of Civil Procedure Section 483.010 or any other related statute or rule.
