Seniority Rights on Return to Work. (a) An employee who returns to work after the expiration of the maternity and/or parental leave will retain the seniority they had accrued immediately prior to commencing the leave and will be credited with seniority for the period covered by the approved leave. (b) The employee will be deemed to have resigned on the date upon which their leave commenced if notice is not given or they do not return to work.
