Common use of Service Plan Clause in Contracts

Service Plan. 2.1 The Customer shall use the following applicable Service Plan and services during the Term: a) the Service Plan specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement); and b) any of the services (“Selected Services”) specified in the Company’s web site “Terms and Conditions” relating to this offer and the aggregate monthly fee (after deduction of any rebate) of such Selected Services is equal to or above the amount specified in the Sales and Services Agreement (if applicable). 2.2 The Service Plan includes an extra SIM card for free. All local data, voice usage and other services will be counted independently between an extra SIM card and registered mobile number under the Service Plan. 2.3 Service Plan with specified data usage Whenever the local data usage of the Customer under the relevant Service Plan nearly reaches the specified local data usage (“Specified Data Usage”) the Company will notify the Customer by SMS. The Customer may by return SMS purchase a top-up at the charge as specified in the SMS received (“Top Up”). If the Customer does not wish to purchase the Top Up, local data service under the relevant Service Plan will be automatically suspended when the data usage has reached the Specified Data Usage. The Customer may purchase the Top Up at that time or wait until the beginning of the next bill month for the new Specified Data Usage allowance under the relevant Service Plan. Any unused top-up local mobile data can be carried forward for free and can be used before the end of the next bill month. This is only applicable to designated service plans (1GB or above) with an “Advise & Consent” mechanism for the purchase of top-up data. 2.3.1 Where the Customer has registered more than one Service Plan in an Account, the Company will notify Customer's primary service number (i.e. the first registered service number) by SMS whenever a Top Up is confirmed. 2.4 Applicable to Customer who stacks a new iPhone Contract: 2.4.1 Under Term (i.e. outstanding months under unexpired Previous Contract Term + iPhone Contract Term), the monthly fee and entitlement of new iPhone Contract takes effect immediately and will apply until the expiration of the new iPhone Contract. 2.4.2 If Customer has an existing contract of FUP Unlimited Data Plan stacks a new iPhone Contract, Customer is required to sign a new contract for FUP Unlimited Data Plan. The monthly fee of new FUP Unlimited Data Plan specified in the Sales and Services Agreement takes effect simultaneously when the new iPhone Contract commences and will apply until the expiration of the Term. 2.5 The Account Holder is responsible for the Service Plan and has complete financial responsibility for the monthly bill of the Service Plan. 2.6 This Service Plan is charged on a monthly basis. The monthly charges for the first month will be charged on a pro-rata basis from the service effective date to the first bill date. The monthly charges are payable in advance and non-refundable under whatever circumstances. 2.7 This Service Plan is not applicable to 2G phones / connected devices or any phones / connected devices which have manually opted for 2G network. However, if customers opt for FUP unlimited data, in addition to the above conditions, the plan will also not applicable to other connected devices (including but not limited to USB modem / pocket wi-fi / TV box). 2.8 If the registered mobile number under the Service Plan is terminated/disconnected or changes to other service plan for whatever reason, all other ▇▇▇▇ under the Service Plan will be terminated at the same time. 2.9 Offer detail Credit offer Credit Amount Wi-Fi Service Plan* full credit back during the Term WiFi Service monthly fee $60 *Customer is required to register for WiFi service 2.10 If the Customer does not notify the Company of termination of the WiFi services specified above prior to the expiry of the Term, the Company shall automatically charge the Customer for the free services specified above at the prevailing monthly fee after the expiry of the Term. 2.11 Free Service Offers: Only available during this Service Plan period. Under this Service Plan, both users of the Registered Number and extra SIM card for free are eligible to enjoy the free service offers. 2.11.1 Free Call Guard service: a) Download, usage and content update of this service will incur data. It will be deducted from relevant subscribed service plans and charged at the applicable thereafter fee. The Customer may by return SMS purchase a top-up of 200MB at the charge as specified in the SMS received $40 (“Top Up”)) for usage of data for the remaining period of that month. If the Customer does not wish to purchase the Top Up, local data service usage under the relevant Service iPhone Monthly Plan will be automatically suspended when the Customer’s data usage has reached reaches the Specified Data Usage. The Customer may purchase the Top Up at that time or wait until the beginning of the next monthly bill month for the new Specified Data Usage allowance under the relevant Service iPhone Monthly Plan. Service Plan. 2.1 The Customer shall use the following applicable Service Plan and services during the Term: a) the Service Plan specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement); and b) any of the services (“Selected Services”) specified in the Company’s web site “Terms and Conditions” relating to this offer and the aggregate a service plan with monthly fee (after deduction of any rebate) of such Selected Services is equal to or above the Service Plan amount specified in the Sales and Services Agreement (if applicablenot applicable to SIM Only service plan).; b) A Service Plan within the “Smartphone Plan – Group 3” (applicable to upgrade to a higher monthly fee during the Term) 2.2 The Service Plan includes an extra SIM card for free. All local data, voice usage and other services will be counted independently between an extra SIM card and registered mobile number under the Service Plan. 2.3 Service Plan with specified data usage usage. Whenever the local data usage of the Customer under the relevant Specified Service Plan nearly reaches the specified local data usage (“Specified Data Usage”) ), the Company will notify the Customer by SMS. The Customer may by return SMS purchase a top-up at the charge as specified in the SMS received (“Top Up”). If the Customer does not wish to purchase the Top Up, local data service under the relevant Specified Service Plan will be automatically suspended when the data usage has reached the Specified Data Usage. The Customer may purchase the Top Up at that time or wait until the beginning of the next bill month for the new Specified Data Usage allowance under the relevant Service Plan. Any unused top-up local mobile data can be carried forward for free and can be used before the end of the next bill month. This is only applicable to designated service plans (1GB or above) with an “Advise & Consent” mechanism for the purchase of top-up data. 2.3.1 Where the Customer has registered more than one Service Plan in an Account, the Company will notify Customer's primary service number (i.e. the first registered service number) by SMS whenever a Top Up is confirmed. 2.4 Applicable to Customer who stacks a new iPhone Contract: 2.4.1 Under Term (i.e. outstanding months under unexpired Previous Contract Term + iPhone Contract Term), the monthly fee and entitlement of new iPhone Contract takes effect immediately and will apply until the expiration of the new iPhone Contract. 2.4.2 If Customer has an existing contract of FUP Unlimited Data Plan stacks a new iPhone Contract, Customer is required to sign a new contract for FUP Unlimited Data Plan. 2.3 The monthly fee of new FUP Unlimited Data Plan specified in the Sales and Services Agreement takes effect simultaneously when the new iPhone Contract commences and will apply until the expiration of the Term. 2.5 The Account Holder is responsible for the Service Plan and has complete financial responsibility for the monthly bill of the Service Plan. 2.6 This Service Plan is charged on a monthly basis. The monthly charges for the first month will be charged on a pro-rata basis from the service effective date to the first bill date. The monthly charges are payable in advance and non-refundable under whatever circumstances. 2.7 This Service 2.4 Applicable to Customer who stacks a new Smartphone Contract: Under Term (i.e. outstanding months under unexpired Previous Contract Term + Smartphone Contract Term), the monthly fee and entitlement of New Plan takes effect immediately and will apply until the expiration of the new Smartphone Contract. 2.5 Designated “6GB or above data usage” monthly service plan (if applicable) Additional data usage charge is not applicable to 2G phones / connected devices or any phones / connected devices which have manually opted for 2G network. However$1/ 10MB, if customers opt for FUP unlimited data, in addition usage is rounded up to the above conditionsnearest 10MB, maximum charge is $168 per month. 2.6 Before contract expires, the plan Company’s retention team will also not applicable to other connected devices (including but not limited to USB modem / pocket wi-fi / TV box). 2.8 If the registered mobile number under the Service Plan is terminated/disconnected or changes to other service plan for whatever reason, all other ▇▇▇▇ under the Service Plan will be terminated at the same time. 2.9 Offer detail Credit offer Credit Amount Wi-Fi Service Plan* full credit back during the Term WiFi Service monthly fee $60 *Customer is required to register for WiFi service 2.10 If the Customer does not notify the Company of termination of the WiFi services specified above prior to the expiry of the Term, the Company shall automatically charge the contact The Customer for the free services specified above at latest re-contract offer. Should the prevailing monthly fee after the Customer decline offer, and upon expiry of existing contract, the TermCustomer will automatically be switched to a then prevailing comparable plan on non-contract basis that is specified from time to time. 2.11 Free Service Offers: Only available during this Service Plan period. Under this Service Plan, both users of the Registered Number and extra SIM card for free are eligible to enjoy the free service offers. 2.11.1 Free Call Guard service: a) Download, usage and content update of this service will incur data. It will be deducted from relevant subscribed service plans and charged at the applicable thereafter fee.
