Common use of Service Plan Clause in Contracts

Service Plan. 2.1 Prioritised FUP Unlimited Data Plan is only available to Customer who has subscribed to a designated “5GB or above data usage” monthly service plan (“Specified Service Plan”). It cannot be used in conjunction with 10GB Add-on Local Data Plan, Multi-SIM Monthly Plan and Tag-On SIM Plan. 2.2 The Customer shall use the following applicable Service Plan and services during the Term: a) the Prioritised FUP Unlimited Data Plan specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement); and b) any of the services (“Selected Services”) specified in the Company’s web site “Terms and Conditions” relating to this offer and the aggregate monthly fee (after deduction of any rebate) of such Selected Services is equal to or above the amount specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement). 2.3 If the Customer has an existing unexpired contract of Prioritised FUP Unlimited Data Plan stacks a new contract of iPhone/Smartphone Plan, the Customer is required to sign a new contract for Prioritised FUP Unlimited Data Plan. The monthly fee of the new Prioritised FUP Unlimited Data Plan as specified in the Sales and Services Agreement shall take effect simultaneously when the new contract for iPhone/Smartphone Plan commences and will apply until the expiration of the Term. 2.4 If the Customer subscribes to a SuperCare Unbundled Smartphone Plan, the monthly fee of Prioritised FUP Unlimited Data Plan specified in the Sales and Services Agreement shall take effect simultaneously when the new SuperCare Unbundled Smartphone Plan commences and will apply until the expiration of the Prioritised FUP Unlimited Data Plan Term. 2.5 Free WiFi service (Not applicable to the Prioritised FUP Unlimited Data purchased for the bill month by monthly subscription) a) Free WiFi service is available to a Customer who has subscribed to a designated Prioritised FUP Unlimited Data Plan. The Customer is required to register for WiFi service. b) Free WiFi service will be terminated if the Customer changes to other service plan 2.6 The Service Plan is charged on a monthly basis. The monthly charges for the first month will be charged on a pro-rata basis from the service effective date to the first bill date. The monthly charges are payable in advance and non-refundable under whatever circumstances. 2.7 After subscription of the Prioritised FUP Unlimited Data Plan, the total local data usage of the Specified Service Plan will be raised to unlimited data usage (subject to Fair Usage Policy, described in Clause 5) for the Term. 2.8 This Service Plan is not applicable to 2G phones / connected devices or any phones / connected devices which have manually opted for 2G network, and not applicable to other connected devices (including but not limited to USB modem / pocket wi-fi / TV box).

The monthly fee of the new Prioritised FUP Unlimited Data Plan as specified in the Sales and Services Agreement shall take effect simultaneously when the new contract for iPhone/Smartphone Plan commences and will apply until the expiration of the Term. 2.4 If the Customer subscribes to a SuperCare Unbundled Smartphone Plan, the monthly fee of Prioritised FUP Unlimited Data Plan specified in the Sales and Services Agreement shall take effect simultaneously when the new SuperCare Unbundled Smartphone Plan commences and will apply until the expiration of the Prioritised FUP Unlimited Data Plan Term. 2.5 Free WiFi service (Not applicable to the Prioritised FUP Unlimited Data purchased for the bill month by monthly subscription)service a) Free WiFi service is available to a Customer who has subscribed to a designated Prioritised FUP Unlimited Data Plan. . b) The Customer with the registered mobile number of the Specified Service Plan (“User of Registered Number”) is required to register for WiFi service. bc) Free WiFi service will be terminated if the Customer changes to other service plan 2.6 2.5 The Service Plan is charged on a monthly basis. It cannot be used in conjunction with 10GB Add-on Local Data Plan, Multi-SIM Monthly Plan and Tag-On SIM Plan. 2.2 The Customer shall use the following applicable Service Plan and services during the Term: a) the Prioritised FUP Unlimited Data “Add-On SIM card” Plan specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement); and b) any of the services (“Selected Services”) specified in the Company’s web site “Terms and Conditions” relating to this offer and the aggregate monthly fee (after deduction of any rebate) of such Selected Services is equal to or above the amount specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement) (where applicable). 2.3 If the Customer has an existing unexpired contract of Prioritised FUP Unlimited Data Specified data usage and voice usage under Specified 5G Service Plan stacks a new contract of iPhone/Smartphone Plan, the Customer is required to sign a new contract for Prioritised FUP Unlimited Data Planwill share between all Add-On SIM cards. The monthly fee accumulated usage of all SIM Cards will be counted towards the usage of the new Prioritised FUP Unlimited Specified 5G Service Plan. 2.4 Applicable to the Service Plan with specified data usage: 2.4.1 The Customer with the registered mobile number of the Specified 5G Service Plan (“User of Registered Number”) can authorize all Add-On SIM card under the same plan to purchase an additional local data usage (“Top Up”). 2.4.2 Whenever the accumulated local usage of all SIM cards under the Specified 5G Service Plan nearly reaches the specified local data usage (“Specified Data Plan Usage”) the Company will send an SMS notification to the User of Registered Number, and other plan users who are authorized to purchase a Top Up. Users may by return SMS purchase a Top Up at the charge as specified in the Sales SMS received. The Company will treat the first SMS reply received as purchase confirmation and Services Agreement shall take effect simultaneously the Top Up local data purchased will be shared between all SIM cards under the Specified Service Plan. If no Top Up is purchased, local data service under the Specified Service Plan will be automatically suspended when the new contract for iPhone/Smartphone Plan commences and will apply accumulated data usage of all ▇▇▇▇ has reached the Specified Data Usage. Users may purchase a Top Up at that time or wait until the expiration beginning of the Term. 2.4 If the Customer subscribes to a SuperCare Unbundled Smartphone Plan, the monthly fee of Prioritised FUP Unlimited Data Plan specified in the Sales and Services Agreement shall take effect simultaneously when next bill month for the new SuperCare Unbundled Smartphone Plan commences and will apply until Specified Data Usage allowance under the expiration of the Prioritised FUP Unlimited Data Plan Termrelevant Service Plan. 2.5 Free WiFi service (Not applicable to the Prioritised FUP Unlimited Data purchased The Account Holder is responsible for the bill month by Specified Service Plan and has complete financial responsibility for the monthly subscription) a) Free WiFi service is available to a Customer who has subscribed to a designated Prioritised FUP Unlimited Data charges of the Specified Service Plan. The Customer is required to register for WiFi service. b) Free WiFi service will be terminated if the Customer changes to other service plan 2.6 The This Service Plan is charged on a monthly basis. The monthly charges for the first month will be charged on a pro-rata basis from the service effective date to the first bill date. The monthly charges are payable in advance and non-refundable under whatever circumstances. 2.7 After subscription of the Prioritised FUP Unlimited Data Plan, the total local data usage of the Specified Service Plan will be raised to unlimited data usage (subject to Fair Usage Policy, described in Clause 5) for the Term. 2.8 This Service Plan is not applicable to 2G phones / connected devices or any phones / connected devices which have has manually opted for 2G network, and not applicable . 2.8 If the registered mobile number under the Specified 5G Service Plan is terminated/disconnected or changes to other connected devices (including but not limited to USB modem / pocket wiservice plan for whatever reason, all other Add-fi / TV box)On SIM cards under the Specified 5G Service Plan will be terminated at the same time.

It cannot be used in conjunction with 10GB other Add-on Local Data Plan, Multi-SIM Monthly Plan and Tag-On SIM Plan. 2.2 The Customer shall use the following applicable Service Plan and services during the Term: a) the Prioritised FUP Unlimited 30GB Data Upgrade Choice Plan specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement); and b) any of the services (“Selected Services”) specified in the Company’s web site “Terms and Conditions” relating to this offer and the aggregate monthly fee (after deduction of any rebate) of such Selected Services is equal to or above the amount specified in the Sales and Services Agreement (or Supplemental Agreement to Sales and Services Agreement). 2.3 If the Customer has an existing unexpired contract of Prioritised FUP Unlimited 30GB Data Upgrade Choice Plan stacks a new contract of iPhone/Smartphone Plan, the Customer is required to sign a new contract for Prioritised FUP Unlimited 30GB Data Upgrade Choice Plan. The monthly fee of the new Prioritised FUP Unlimited 30GB Data Upgrade Choice Plan as specified in the Sales and Services Agreement shall take effect simultaneously when the new contract for iPhone/Smartphone Plan commences and will apply until the expiration of the Term. 2.4 If the Customer subscribes to a SuperCare Unbundled Smartphone Plan, the monthly fee of Prioritised FUP Unlimited 30GB Data Upgrade Choice Plan specified in the Sales and Services Agreement shall take effect simultaneously when the new SuperCare Unbundled Smartphone Plan commences and will apply until the expiration of the Prioritised FUP Unlimited 30GB Data Upgrade Choice Plan Term. 2.5 Free WiFi service (Not applicable to the Prioritised FUP Unlimited Data purchased for the bill month by monthly subscription) a) Free WiFi service is available to a Customer who has subscribed to a designated Prioritised FUP Unlimited Data Plan. The monthly charges are payable in advance and non-refundable under whatever circumstances. 2.7 2.6 After subscription of the Prioritised FUP Unlimited Data Plan, the total local data usage of the Specified Service Plan will be raised to unlimited data usage (subject to Fair Usage Policy, described in Clause 5) for the Term. 2.8 This 2.7 Service Plan is not only applicable to phone usage (except for 2G phones / connected devices or any phones / connected devices which have has manually opted for 2G network), and but not applicable to other any connected devices (including but not limited to USB modem / pocket wi-fi / TV box)devices.
