Common use of Service Volumes Clause in Contracts

Service Volumes. (a) No Guaranteed Minimum or Exclusivity The Operator acknowledges and agrees that the Region does not guarantee to the Operator: (i) any minimum number of procedures comprising the Services which may be required or requested; or (ii) any minimum payment of Service Fees or other funding in relation to the undertaking by the Operator of the Operator's obligations under this Agreement; or (iii) any right of exclusivity in terms of the provision of the Services in the Region. (b) Maximum Procedure Volumes Schedule B provides a description of the Services to be performed by the Operator pursuant to this Agreement and sets forth the maximum achievable Service Fees payable under this Agreement based on the anticipated maximum volumes for the procedures comprising the Services required to be provided by the Operator during the Term utilising the Region's current best estimates for anticipated demand within the Region. The Operator specifically acknowledges and agrees that the Region does not represent or warrant that the stated maximum Service Fees or volumes of procedures or any specified proportions thereof, will be realised or achieved by the Operator. (c) Future Volumes The Region agrees to undertake a review of the in-hospital procedures to determine the benefits of re-allocating additional procedures to the Facility.
