Services Tools. SkillsTX may use tools, scripts, software, and utilities (collectively, the “tools”) to monitor and administer the services and to help resolve your SkillsTX service requests. The tools will not collect, report or store any of your data residing in the service production environment, except as necessary to troubleshoot service requests or other problems in the service. Data collected by the tools (excluding production data) may also be used to assist in managing SkillsTX’s product and service portfolio and for licence management. You agree that (a) except as set forth in the following paragraph, you may not access or use the tools, and (b) you will not use or restore the tools from any tape backup at any time following termination of the agreement. If SkillsTX provides you with access to or use of any tools in connection with the services, your right to use such tools is governed by the licence terms that SkillsTX specifies for such tools; however, if SkillsTX does not specify licence terms for such tools, you shall have a non-transferable, non-exclusive, limited right to use such tools solely to facilitate your administration and monitoring of your services environment, subject to the terms of the agreement. Any such tools are provided by SkillsTX on an “as is” basis and SkillsTX does not provide technical support or offer any warranties for such tools. Your right to use such tools will terminate upon the earlier of SkillsTX’s notice (which may be through posting on xxxxx://xx.xxxxxxxx.xxx or such other URL designated by SkillsTX), the end of the services term, or the date that the licence to use such tools ends under the licence terms specified for such tools.

The Tools will not collect, report or store any of Your Data residing in the Online Service, except as necessary to troubleshoot service requests or other problems in the Online Service. Since data collected by the Tools is current, the data may also be used to assist in managing Quantis' product and service portfolio and for license management.

TechniPhi does not specify license terms for such tools Any such tools are provided by TechniPhi on an “as is” basis and TechniPhi does not provide technical support or offer any warranties for such tools. Unless the Owner of the tool provides otherwise, Your right to use such tools will terminate upon the earlier of TechniPhi’s notice, the end of the Services term, or the date that the license to use such tools ends under the license terms specified for such tools.

If Customer uses the companion pocket survey tool in connection with the Services, Customer shall have a non-transferable, non- exclusive, limited right to use such tool solely to facilitate Customer’s administration and monitoring of Customer’s Services environment, subject to the terms of the Agreement. Customer’s right to use such tool will terminate upon the earlier of SFS’s notice or the end of the Services term.

The Tools will not collect, report, or store any of Customer Data residing in the production SaaS, except as necessary to troubleshoot service requests or other problems or issues in the SaaS. Data collected by the Tools (excluding production data) may also be used to assist in managing NTI’s product and service portfolio and for license management.
