SHIPMENT/DELIVERY. As used in this AGREEMENT, the term “DELIVERY” and its derivatives mean delivery “FOB, SELLER’s FACILITY.” SELLER shall retain the risk of loss in accordance with these terms. Title shall pass concurrently with the risk of loss passing from SELLER to BUYER.
