Common use of SLEEPING CAPACITY/DISTURBANCES Clause in Contracts

SLEEPING CAPACITY/DISTURBANCES. Tenant and all other occupants of the premises will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the sleeping capacity of the property, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts that interfere with neighbors' right to quiet enjoyment of their premises. HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) loss, damage, illness, injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

HOLD HARMLESS None of WPVP, iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises Owner, do not assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) for loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved may include a community pool pool, tennis courts, exercise room and other common areas and the undersigned agrees and acknowledges that the community pool and pool, patio/deck deck, tennis courts and exercise rooms can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved may include a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas. MAINTENANCE Please report any maintenance/damages to us upon your arrival. Refunds will not be made for maintenance issues including, but not limited to heating and air conditioning, appliances, televisions, and stereos. INTERNET Beaches of Alabama is not responsible for internet service interruptions due to local service provider outages / maintenance issues. Should you require internet during your stay, it is recommended that you bring a backup portable hot spot supported by your cell service carrier.

HOLD HARMLESS None Hotel owners or appointed property management may remove any guest who, while on the premises, illegally possesses or sells controlled substances; is intoxicated, profane, lewd, or brawling; disturbs the peace of other guests; injures the facility's reputation, dignity, or standing; fails to pay the agreed upon rent at checkout time; or fails to checkout at the agreed upon checkout time. The hotel owner must give the guest notice of his desire for the guest to depart and return the unused portion of any advance payment. Guests who refuse to leave are guilty of a second-degree misdemeanor. Hotel owners may call any law enforcement officer to arrest illegal guests. Arrested guests are deemed to have given up or abandoned their right to occupy a room, thus the hotel owner may make it available to other guests. iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises Owner, does not assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) for loss, damage, illness, or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include includes a community pool/spa or a private pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises Owner, does not assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) for loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) property. Neither does Owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet or Internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. POOL & PATIO If Tenant, as well as any guest of Tenant, understands and agrees that iTrip Vacations or the premises include a private Owner, does not asume any liability for loss, damage or community pool (including hot tubs)injury to persons or their personal property with respect to use of amenities provided for use at the property including, then but not limited to, chairs, swings, bikes, paddleboards, kayaks, floats, firepits, BBQ grills, toys or games. Tenant understands that the consumption of alcoholic beverages or use of drugs, prior to, or during, is unsafe for any type of water activity. Tenant hereby acknowledges that IF the premises they have reserved include includes a community pool and or private pool, the undersigned agrees and acknowledges that the community or private pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the community or private or community pool (including hot tubs) and patio areas.

LLC, or the owner Owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any for (i) loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the iTrip is not responsible for any personal belongings left behind. Tenant hereby acknowledges that the premises they have reserved include includes a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises Owner, does not assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) for loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. POOL iTrip or Owner does not assume any liability for loss, damage or injury for use of bunk beds. K & PATIO If K Vacation Rentals, LLC d/b/a iTrip Vacations Aspen Snowmass (“iTrip”) has put in place preventative measures to reduce the premises include a private spread of COVID-19; however, COVID-19 is highly contagious and iTrip cannot guarantee that you, your family members or community pool guests (including hot tubs)collectively “You” or “Your”) will not be exposed to or become infected with COVID-19. Further, then traveling could increase Your risk of being exposed to and/or contracting COVID-19. Exposure could result in quarantine requirements, personal injury, illness, permanent disability or death. Due to the nature of the facilities, services, and programs offered by iTrip, social distancing of 6 feet per person between You and iTrip staff and disinfecting of all surfaces in which You may come into contact may not always be possible. To reduce Your risk, iTrip strongly recommends You familiarize yourself and comply with all effective health orders during your stay. Tenant hereby acknowledges that if the premises they have reserved include includes a community pool and pool, hot tub or private hot tub the undersigned agrees and acknowledges that these facilities and the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the community pool, hot tub, private or community pool (including hot tubs) tub and patio areas.

SLEEPING CAPACITY/DISTURBANCES. Tenant and all other occupants of the premises will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding These properties are monitored by the sleeping capacity Noise-Aware System, Minut Noise Monitoring or both for verification of the propertyan issue. Parties are not allowed and if found, using will be required to depart the premises for any illegal activity, causing damage and a $500 penalty. This includes family gatherings. Property occupancy shall not exceed the maximum # of persons allowed to the premises rented or to any of the neighboring properties and any other acts that interfere with neighbors' right to quiet enjoyment of their premisessleep on property. HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property ManagementFlorida’s First Coast Vacations LLC, Inc. or the owner Owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any for (i) loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, God or other reasons beyond their control. POOL & PATIO If This includes the premises include a private or community pool (including use of any amenities that could include, hot tubs)tub, then the pool, bicycles, wagon, games, BBQ, appliances, fire pit, rubber boat, life vests, Level 2 EV Charger, etc. Tenant hereby acknowledges that the premises they have reserved may include a community pool (depending on the property) and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areasareas where applicable. This is also applicable to the use of any amenities et al; patio, bbq, meat smoker, fire pit, outdoor furniture & appliances, kids pack n' play, bicycles, wagons, boogie boards, beach chairs, rubber boat, life vests, dart game, corn hole game, Level 2 EV Charger, Kayak's, Canoe's, Rafts, Surfboard, etc.

Neither does Owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet or Internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. POOL & PATIO If In consideration of being permitted to rent and stay at the premises include a private Premises, Xxxxxx agrees on Xxxxxx’s own behalf and on behalf of Xxxxxx’s family and guests and on behalf of Xxxxxx’s children and all minors in Tenant’s care, custody or community pool control (including hot tubshereafter also included in “Tenant”) to assume full responsibility for the risks identified herein and those risks not specifically identified. Tenant hereby releases from liability and waives any and all claims that Tenant has or may have in the future against the Owner, the Homeowner's Association (where applicable), then the iTrip and their members, principals, agents, officers, employees, and representatives (collectively “Releasees”). Tenant hereby acknowledges that if there is a pool and/or spa on the premises they have reserved include property, it poses a community pool risk to any and all guests on the undersigned agrees property. Tenant understands and acknowledges that the community pool use of other equipment (including Recreational Equipment as defined below) and patio/deck can be dangerous areasfacilities provided by Releasees and participation in outdoor activities, involves risks including, but not limited to the following: risk of property damage, bodily injury, including, but not limited to permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of Tenant or others, or from the unavailability of emergency medical care. Tenant is also aware that Xxxxxx’s stay at the Premises involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Premises during Tenant’s stay, and the condition of the property. Tenant understands that the deck/patio can be slippery when wet, description of the risks in this Agreement is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury may occur and or/death. Tenant understands and acknowledges that being in or near the ocean presents various risks and hazards, including strong currents, unexpected wave activity, floating debris and other potential hazards. Tenant assumes all such risks associated with being near or in the ocean. Tenant hereby agrees that if Tenant rents, operates or uses equipment, including but not limited to anyone who bikes, chairs, paddleboards, boogie boards, kayaks, floats, canopies, firepits, BBQ grills, umbrellas, toys or games (“Recreational Equipment”) provided by Releasees, Tenant does so at Tenant’s own risk. Xxxxxx agrees that Xxxxxx will inspect the Recreational Equipment and ensure that any defects are brought to Releasees’ attention. Tenant will also ensure that all measures are taken to prevent the Recreational Equipment from causing injury to Tenant or others. Xxxxxx agrees that Xxxxxx is not careful. With full knowledge voluntarily participating in all activities related to the rental, operation, or use of the above facts and warningsRecreational Equipment, the undersigned Tenant accepts and assumes all risk of injury, illness, damage or loss that might result, even if the risks involved to arise out of the negligence or fault of Releasees. Tenant agrees that Releasees shall not be liable for any damages arising from personal injuries Tenant or anyone under Xxxxxx’s custody, care, and control, sustain as a result of any and all of Tenant's guests in or activities related to the rental, operation, or use of Recreational Equipment provided by Releasees. Tenant assumes full responsibility for any such injuries or damages which may occur, and further agrees that Releasees shall not be liable for any loss or theft of personal property. Tenant specifically agrees that Releasees shall not be responsible for such injuries, damages, loss or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY Releasees whether such negligence is present at the private signing of this Agreement or community pool takes place in the future. This Waiver and Release does not apply to gross negligence or intentional torts by Releasees. Xxxxxx agrees to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from arise out of or be related in any way to Tenant’s rental and stay at the Premises or use of equipment including the Recreational Equipment. If any portion of this Agreement shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Agreement and the remainder of the Agreement shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. Xxxxxx agrees to defend, indemnify, and hold the Releasees harmless from and against all obligations, claims, damages, demands, penalties, liabilities, causes of action, costs and expenses of whatsoever kind, including, but not limited to, reasonable attorneys' fees and costs (including hot tubsthose incurred for experts), at both the trial and appellate levels (collectively “Claims”), imposed upon or incurred by or asserted against Releasees arising out of or relating to: (a) and patio areas.any accident or injury to, or death of, persons or loss of or damage to property occurring on or about the Premises or any portion thereof during Tenant’s rental term;

POOL iTrip or Owner does not assume any liability for loss, damage or injury for use of bunk beds. Further, then traveling could increase Your risk of being exposed to and/or contracting COVID-19. Exposure could result in quarantine requirements, personal injury, illness, permanent disability or death. POOL Xxxxxx agrees to indemnify, defend and hold the Owner and iTrip Sarasota & PATIO If Venice, its landlard, officers, employees, and agents harmless of and from any liabilities, costs, penalties, or expenses arising out of and/or resulting from the rental and use of the premises include a private or community pool (and any items and/or equipment found on the premises, including hot tubs)but not limited to bicycles, then the pools, seawalls, canals, tidal pools, lakes, grills etc. Tenant hereby acknowledges that the premises they have reserved might include a community pool or a private pool or a seawall or dock and the undersigned agrees and acknowledges that the community pool and patio/deck deck, the seawall and the dock can be dangerous areas, that the deck/patio patio/seawall/dock can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and pool, patio areas, seawalls and docks. YOU ARE RESPONSIBLE FOR YOUR CHILDREN! No jumping or diving into the pool. Tenant and guests must follow all posted rules, including keeping the water at the proper level or advising iTrip Sarasota & Venice, if necessary and keeping toys out of pool during the night. If the property contains a tidal pool, lake, pond or canal, there is NO SWIMMING in these bodies of water. This property offers gas heater service optional for an additional charge located in the property description. The temperature of swimming pools varies and highly depends on the current day and night temperatures and wind. Therefore, we cannot guarantee a particular pool temperature during the time of your stay. The optional pool heater service must be ordered and paid before our service personnel can turn it on. We suggest ordering pool heat a day before you want it. We will do our best to try to accommodate any late order AND the pool may take time to heat. A pool may take several days to heat up and depends on the ambient temperature, water temperature, wind, rain and size of the pool. During or after periods of cold weather (esp. winter cold front) it may take longer or not really heat up until air gets warmer. Pools consist of thousands of gallons of water. No commercially available pool heater can heat that much water instantly. Please plan ahead and also understand that pool heaters have limits on capability. In case of a technical malfunction, we will refund the pool heat charge for the time the heat service was not available to you. No further credit will be given if pool equipment fails or is unavailable for any reason. We do not guarantee any specific temperature with pool heat service and no refunds can be provided. Understanding pool heat: The pool heater and circulation pump are usually running during daytime hours. Both are typically off at night. No water circulation or a red light at the equipment does NOT indicate any malfunction when the pump is off. Residential pool heaters are NOT run 24/7. Disclaimer: It is your responsibility to keep water level at the correct height between pool service visits. If water level gets too low (due to evaporation between pool service visits) the pool heater will NOT work. During times of low precipitation or when the pool water is heated and higher than ambient temperature, evaporation may lower the water level to a degree where the circulation pump is sucking air. The correct water level is for the water to be halfway up the skimmer inlet (the open square box). Fill with the provided garden hose. Insufficient water levels can damage the pool heater and the pool filter and may cause both to stop working. You can easily notice the noise change for a pool that does not contain sufficient water. The pool heat cannot be set higher than that maximum temperature (86°F) in order to keep chemicals balanced. If you want a “hot” pool use the SPA, as these smaller pieces are equipped for higher temperatures. Swimming pools are NOT intended for higher temperatures. Setting a pool to a higher temperature would trigger additional maintenance (bi-weekly pool service, increase in chemicals usage, increase in electricity) which are NOT included in the pool heat fee. IT IS VERY IMPORTANT THAT YOU NOT TOUCH ANY OF THE POOL EQUIPMENT. ONLY THE POOL SERVICE PROVIDER IS ALLOWED TO TOUCH THIS! Combined a spa/pool: If you would like to use the spa you will need to order pool heat otherwise, the spa won't heat up. During usage of the spa, the pool will not be heated. Switching between the pool/spa will trigger a protection pause for the heat pump. So using the spa will practically prevent the pool from being heating during that time. Since there is a pool automation system installed the temperature reading on the heat pump itself will not be accurate.

During times of low precipitation or when the pool water is heated and higher than ambient temperature, evaporation may lower the water level to a degree where the circulation pump is sucking air. The correct water level is for the water to be halfway up the skimmer inlet (the open square box). Fill with the provided garden hose. Insufficient water levels can damage the pool heater and the pool filter and may cause both to stop working. You can easily notice the noise change for a pool that does not contain sufficient water. The pool heat cannot be set higher than that maximum temperature (86°F) in order to keep chemicals balanced. If you want a “hot” pool use the SPA, as these smaller pieces are equipped for higher temperatures. Swimming pools are NOT intended for higher temperatures. Setting a pool to a higher temperature would trigger additional maintenance (bi-weekly pool service, increase in chemicals usage, increase in electricity) which are NOT included in the pool heat fee. IT IS VERY IMPORTANT THAT YOU NOT TOUCH ANY OF THE POOL EQUIPMENT. ONLY THE POOL SERVICE PROVIDER IS ALLOWED TO TOUCH THIS! Combined a spa/pool: If you would like to use the spa you will need to order pool heat otherwise, the spa won't heat up. During usage of the spa, the pool will not be heated. Switching between the pool/spa will trigger a protection pause for the heat pump. So using the spa will practically prevent the pool from being heating during that time. Since there is a pool automation system installed the temperature reading on the heat pump itself will not be accurate.

POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

Property occupancy shall not exceed the maximum # of persons allowed to the premises rented or to any of the neighboring properties and any other acts that interfere with neighbors' right to quiet enjoyment of their premisessleep on property. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areasareas where applicable. This is also applicable to the use of any amenities et al; patio, bbq, meat smoker, fire pit, outdoor furniture & appliances, kids pack n' play, bicycles, wagons, boogie boards, beach chairs, etc.

HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property ManagementFlorida’s First Coast Vacations LLC, Inc. or the owner Owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any for (i) loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, God or other reasons beyond their control. POOL & PATIO If This includes the premises include a private or community pool (including use of any amenities that could include, hot tubs)tub, then the pool, bicycles, wagon, games, BBQ, appliances, fire pit, etc. POOL, PATIO, BBQ, COMMON AREA, PACK N' PLAY, BICYCLES, WAGON, BEACH GEAR, OUTDOOR FURNITURE, etc. Tenant hereby acknowledges that the premises they have reserved may include a community pool (depending on the property) and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areasareas where applicable. This is also applicable to the use of any amenities et al; patio, bbq, meat smoker, fire pit, outdoor furniture & appliances, kids pack n' play, bicycles, wagons, boogie boards, beach chairs, etc.

HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises Owner, does not assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) for loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) property. Neither does Owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet or Internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. POOL & PATIO If In consideration of being permitted to rent and stay at the premises include a private Premises, Xxxxxx agrees on Xxxxxx’s own behalf and on behalf of Xxxxxx’s family and guests and on behalf of Xxxxxx’s children and all minors in Tenant’s care, custody or community pool control (including hot tubs), then hereafter also included in “Tenant”) to assume full responsibility for the risks identified herein and those risks not specifically identified. Tenant hereby releases from liability and waives any and all claims that Tenant has or may have in the future against Sunset Properties, LLC, iTrip and their members, principals, agents, officers, employees, and representatives (collectively “Releasees”). Tenant acknowledges that if there is a pool and/or spa on the premises they have reserved include property, it poses a community pool risk to any and all guests on the undersigned agrees property. Tenant understands and acknowledges that the community pool use of other equipment (including Recreational Equipment as defined below) and patio/deck can be dangerous areasfacilities provided by Releasees and participation in outdoor activities, involves risks including, but not limited to the following: risk of property damage, bodily injury, including, but not limited to permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of Tenant or others, or from the unavailability of emergency medical care. Tenant is also aware that Xxxxxx’s stay at the Premises involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Premises during Tenant’s stay, and the condition of the property. Tenant understands that the deck/patio can be slippery when wet, description of the risks in this Agreement is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury may occur and or/death. Tenant understands and acknowledges that being in or near the ocean presents various risks and hazards, including strong currents, unexpected wave activity, floating debris and other potential hazards. Tenant assumes all such risks associated with being near or in the ocean. Tenant hereby agrees that if Tenant rents, operates or uses equipment, including but not limited to anyone who bikes, chairs, paddleboards, boogie boards, kayaks, floats, canopies, firepits, BBQ grills, umbrellas, toys or games (“Recreational Equipment”) provided by Releasees, Tenant does so at Tenant’s own risk. Xxxxxx agrees that Xxxxxx will inspect the Recreational Equipment and ensure that any defects are brought to Releasees’ attention. Tenant will also ensure that all measures are taken to prevent the Recreational Equipment from causing injury to Tenant or others. Xxxxxx agrees that Xxxxxx is not careful. With full knowledge voluntarily participating in all activities related to the rental, operation, or use of the above facts and warningsRecreational Equipment, the undersigned Tenant accepts and assumes all risk of injury, illness, damage or loss that might result, even if the risks involved to arise out of the negligence or fault of Releasees. Tenant agrees that Releasees shall not be liable for any damages arising from personal injuries Tenant or anyone under Xxxxxx’s custody, care, and control, sustain as a result of any and all of Tenant's guests in or activities related to the rental, operation, or use of Recreational Equipment provided by Releasees. Tenant assumes full responsibility for any such injuries or damages which may occur, and further agrees that Releasees shall not be liable for any loss or theft of personal property. Tenant specifically agrees that Releasees shall not be responsible for such injuries, damages, loss or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY Releasees whether such negligence is present at the private signing of this Agreement or community pool takes place in the future. This Waiver and Release does not apply to gross negligence or intentional torts by Releasees. Xxxxxx agrees to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from arise out of or be related in any way to Tenant’s rental and stay at the Premises or use of equipment including the Recreational Equipment. If any portion of this Agreement shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Agreement and the remainder of the Agreement shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. Xxxxxx agrees to defend, indemnify, and hold the Releasees harmless from and against all obligations, claims, damages, demands, penalties, liabilities, causes of action, costs and expenses of whatsoever kind, including, but not limited to, reasonable attorneys' fees and costs (including hot tubsthose incurred for experts), at both the trial and appellate levels (collectively “Claims”), imposed upon or incurred by or asserted against Releasees arising out of or relating to: (a) and patio areas.any accident or injury to, or death of, persons or loss of or damage to property occurring on or about the Premises or any portion thereof during Tenant’s rental term;

SLEEPING CAPACITY/DISTURBANCES. Tenant and all other occupants of the premises will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding These properties are monitored by the sleeping capacity Noise-Aware System, Minut Noise Monitoring or both for verification of the propertyan issue. Parties are not allowed and if found, using will be required to depart the premises for any illegal activity, causing damage and a $500 penalty. This includes family gatherings. Property occupancy shall not exceed the maximum # of persons allowed to the premises rented or to any of the neighboring properties and any other acts that interfere with neighbors' right to quiet enjoyment of their premisessleep on property. HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property ManagementFlorida’s First Coast Vacations LLC, Inc. or the owner Owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any for (i) loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, God or other reasons beyond their control. POOL & PATIO If This includes the premises include a private or community pool (including use of any amenities that could include, hot tubs)tub, then the pool, bicycles, wagon, games, BBQ, appliances, fire pit, surf boards, kayak's, boogie boards, etc. Tenant hereby acknowledges that the premises they have reserved may include a community pool (depending on the property) and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areasareas where applicable. This is also applicable to the use of any amenities et al; patio, bbq, meat smoker, fire pit, outdoor furniture & appliances, kids pack n' play, bicycles, wagons, boogie boards, surf boards, kayak's, beach chairs, rubber boat, life vests, dart game, corn hole game, etc.

POOL iTrip or Owner does not assume any liability for loss, damage or injury for use of bunk beds. K & PATIO If K Vacation Rentals, LLC d/b/a iTrip Vacations Aspen Snowmass (“iTrip”) has put in place preventative measures to reduce the premises include a private spread of COVID-19; however, COVID-19 is highly contagious and iTrip cannot guarantee that you, your family members or community pool guests (including hot tubs)collectively “You” or “Your”) will not be exposed to or become infected with COVID-19. Further, then traveling could increase Your risk of being exposed to and/or contracting COVID-19. Exposure could result in quarantine requirements, personal injury, illness, permanent disability or death. Due to the nature of the facilities, services, and programs offered by iTrip, social distancing of 6 feet per person between You and iTrip staff and disinfecting of all surfaces in which You may come into contact may not always be possible. To reduce Your risk, iTrip strongly recommends You familiarize yourself and comply with all effective health orders during your stay. Tenant hereby acknowledges that if the premises they have reserved include includes a community pool and pool, hot tub or private hot tub the undersigned agrees and acknowledges that these facilities and the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the community pool, hot tub, private or community pool (including hot tubs) tub and patio areas.

HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises Owner, does not assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) for loss, damage, illness, damage or injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniencesplumbing, damage, loss or injury arising from or as well as due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their its control. Tenant agrees to indemnify, defend, and hold the Owner and iTrip Vacations Sarasota & Venice, its landlord, officers, employees, and agents harmless of and from any liabilities, costs, penalties, or expenses arising out of and/or resulting from the rental and use of the premises and any items and/or equipment found on the premises, including but not limited to bicycles. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include includes a pool and/or a community pool and the undersigned agrees and acknowledges that the community pool and pool(s)and patio/deck deck(s) can be dangerous areas, that the deck/patio patio(s) can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

Tenant hereby acknowledges that the premises they have reserved include includes a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.
