SLEEPING CAPACITY/DISTURBANCES. HOLD HARMLESS None of iTrip Vacations, Sea Oats Vacation Property Management, Inc. or the owner of the premises assume risk, responsibility or any liability for, and the Tenant hereby releases, waives, relinquishes and discharges iTrip Vacations, Sea Oats Vacation Property Management, Inc., the owner of the premises and all directors, officers, employees, agents or other representatives of such parties from, any (i) loss, damage, illness, injury or exposure to COVID-19, other viruses or the flu to persons or their personal property that occurs during their stay on the premises; (ii) any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, internet service, electricity or plumbing or (iii) any inconveniences, damage, loss or injury arising from or due to weather conditions, insects, natural disasters, acts of God, or other reasons beyond their control. POOL & PATIO If the premises include a private or community pool (including hot tubs), then the Tenant hereby acknowledges that the premises they have reserved include a community pool and the undersigned agrees and acknowledges that the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

MAINTENANCE Please report any maintenance/damages to us upon your arrival. Refunds will not be made for maintenance issues including, but not limited to heating and air conditioning, appliances, televisions, and stereos. INTERNET Beaches of Alabama is not responsible for internet service interruptions due to local service provider outages / maintenance issues. Should you require internet during your stay, it is recommended that you bring a backup portable hot spot supported by your cell service carrier.

The hotel owner must give the guest notice of his desire for the guest to depart and return the unused portion of any advance payment. Guests who refuse to leave are guilty of a second-degree misdemeanor. Hotel owners may call any law enforcement officer to arrest illegal guests. Further, then traveling could increase Your risk of being exposed to and/or contracting COVID-19. Exposure could result in quarantine requirements, personal injury, illness, permanent disability or death. Due to the nature of the facilities, services, and programs offered by iTrip, social distancing of 6 feet per person between You and iTrip staff and disinfecting of all surfaces in which You may come into contact may not always be possible. To reduce Your risk, iTrip strongly recommends You familiarize yourself and comply with all effective health orders during your stay. Tenant hereby acknowledges that if the premises they have reserved include includes a community pool and pool, hot tub or private hot tub the undersigned agrees and acknowledges that these facilities and the community pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. Tenant hereby releases from liability and waives any and all claims that Tenant has or may have in the future against the Owner, the Homeowner's Association (where applicable), then the iTrip and their members, principals, agents, officers, employees, and representatives (collectively “Releasees”). Tenant hereby acknowledges that if there is a pool and/or spa on the premises they have reserved include property, it poses a community pool risk to any and all guests on the undersigned agrees property. Tenant understands and acknowledges that the community pool use of other equipment (including Recreational Equipment as defined below) and patio/deck can be dangerous areasfacilities provided by Releasees and participation in outdoor activities, involves risks including, but not limited to the following: risk of property damage, bodily injury, including, but not limited to permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of Tenant or others, or from the unavailability of emergency medical care. Tenant is also aware that Xxxxxx’s stay at the Premises involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Premises during Tenant’s stay, and the condition of the property. Tenant understands that the deck/patio can be slippery when wet, description of the risks in this Agreement is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury may occur and or/death. Tenant understands and acknowledges that being in or near the ocean presents various risks and hazards, including strong currents, unexpected wave activity, floating debris and other potential hazards. Tenant assumes all such risks associated with being near or in the ocean. Tenant hereby agrees that if Tenant rents, operates or uses equipment, including but not limited to anyone who bikes, chairs, paddleboards, boogie boards, kayaks, floats, canopies, firepits, BBQ grills, umbrellas, toys or games (“Recreational Equipment”) provided by Releasees, Tenant does so at Tenant’s own risk. Xxxxxx agrees that Xxxxxx will inspect the Recreational Equipment and ensure that any defects are brought to Releasees’ attention. Tenant will also ensure that all measures are taken to prevent the Recreational Equipment from causing injury to Tenant or others. Xxxxxx agrees that Xxxxxx is not careful. With full knowledge voluntarily participating in all activities related to the rental, operation, or use of the above facts and warningsRecreational Equipment, the undersigned Tenant accepts and assumes all risk of injury, illness, damage or loss that might result, even if the risks involved to arise out of the negligence or fault of Releasees. Tenant agrees that Releasees shall not be liable for any damages arising from personal injuries Tenant or anyone under Xxxxxx’s custody, care, and control, sustain as a result of any and all of Tenant's guests in or activities related to the rental, operation, or use of Recreational Equipment provided by Releasees. Tenant assumes full responsibility for any such injuries or damages which may occur, and further agrees that Releasees shall not be liable for any loss or theft of personal property. Tenant specifically agrees that Releasees shall not be responsible for such injuries, damages, loss or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY Releasees whether such negligence is present at the private signing of this Agreement or community pool takes place in the future. This Waiver and Release does not apply to gross negligence or intentional torts by Releasees. Xxxxxx agrees to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from arise out of or be related in any way to Tenant’s rental and stay at the Premises or use of equipment including the Recreational Equipment. If any portion of this Agreement shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Agreement and the remainder of the Agreement shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. Xxxxxx agrees to defend, indemnify, and hold the Releasees harmless from and against all obligations, claims, damages, demands, penalties, liabilities, causes of action, costs and expenses of whatsoever kind, including, but not limited to, reasonable attorneys' fees and costs (including hot tubsthose incurred for experts), at both the trial and appellate levels (collectively “Claims”), imposed upon or incurred by or asserted against Releasees arising out of or relating to: (a) and patio areas.any accident or injury to, or death of, persons or loss of or damage to property occurring on or about the Premises or any portion thereof during Tenant’s rental term;

This property offers gas heater service optional for an additional charge located in the property description. The temperature of swimming pools varies and highly depends on the current day and night temperatures and wind. Therefore, we cannot guarantee a particular pool temperature during the time of your stay. The optional pool heater service must be ordered and paid before our service personnel can turn it on. We suggest ordering pool heat a day before you want it. We will do our best to try to accommodate any late order AND the pool may take time to heat. A pool may take several days to heat up and depends on the ambient temperature, water temperature, wind, rain and size of the pool. During or after periods of cold weather (esp. winter cold front) it may take longer or not really heat up until air gets warmer. Pools consist of thousands of gallons of water. No commercially available pool heater can heat that much water instantly. Please plan ahead and also understand that pool heaters have limits on capability. Fees: • Minimum charge for pool heat is one week. Disclaimer: No specific pool temperature is guaranteed by this service. We setpool heat between 84 and 86 degrees. During and after winter cold fronts, the heater may struggle or be unable to keep the water at the same temperature until the weather gets warmer. You pay for gas for the pool heater for a minimum of 8 hours to a maximum of 10 hours per day. The pool heater will be off during the night. Without optional pool heat, pool water temperatures may plummet in December to March, especially during cold periods. The pool heater will help warm up the pool faster when it gets warmer outside, however you should not expect “bathtub temperatures” during or after Florida winter cold fronts. Disclaimer: We reserve the right to make pool heat unavailable at any time for maintenance or repairs. In case of a technical malfunction, we will refund the pool heat charge for the time the heat service was not available to you. No further credit will be given if pool equipment fails or is unavailable for any reason. We do not guarantee any specific temperature with pool heat service and no refunds can be provided. Understanding pool heat: The pool heater and circulation pump are usually running during daytime hours. Both are typically off at night. No water circulation or a red light at the equipment does NOT indicate any malfunction when the pump is off. Residential pool heaters are NOT run 24/7. Disclaimer: It is your responsibility to keep water level at the correct height between pool service visits. If water level gets too low (due to evaporation between pool service visits) the pool heater will NOT work. During times of low precipitation or when the pool water is heated and higher than ambient temperature, evaporation may lower the water level to a degree where the circulation pump is sucking air. The correct water level is for the water to be halfway up the skimmer inlet (the open square box). Fill with the provided garden hose. Insufficient water levels can damage the pool heater and the pool filter and may cause both to stop working. You can easily notice the noise change for a pool that does not contain sufficient water. The pool heat cannot be set higher than that maximum temperature (86°F) in order to keep chemicals balanced. If you want a “hot” pool use the SPA, as these smaller pieces are equipped for higher temperatures. Swimming pools are NOT intended for higher temperatures. Setting a pool to a higher temperature would trigger additional maintenance (bi-weekly pool service, increase in chemicals usage, increase in electricity) which are NOT included in the pool heat fee. IT IS VERY IMPORTANT THAT YOU NOT TOUCH ANY OF THE POOL EQUIPMENT. ONLY THE POOL SERVICE PROVIDER IS ALLOWED TO TOUCH THIS! Combined a spa/pool: If you would like to use the spa you will need to order pool heat otherwise, the spa won't heat up. During usage of the spa, the pool will not be heated. Switching between the pool/spa will trigger a protection pause for the heat pump. So using the spa will practically prevent the pool from being heating during that time. Since there is a pool automation system installed the temperature reading on the heat pump itself will not be accurate.

We suggest ordering pool heat a day before you want it. We will do our best to try to accommodate any late order AND the pool may take time to heat. A pool may take several days to heat up and depends on the ambient temperature, water temperature, wind, rain and size of the pool. During or after periods of cold weather (esp. winter cold front) it may take longer or not really heat up until air gets warmer. Pools consist of thousands of gallons of water. No commercially available pool heater can heat that much water instantly. Please plan ahead and also understand that pool heaters have limits on capability. Fees: • Minimum charge for pool heat is one week. Disclaimer: No specific pool temperature is guaranteed by this service. We setpool heat between 84 and 86 degrees. During and after winter cold fronts, the heater may struggle or be unable to keep the water at the same temperature until the weather gets warmer. You pay for gas for the pool heater for a minimum of 8 hours to a maximum of 10 hours per day. The pool heater will be off during the night. Without optional pool heat, pool water temperatures may plummet in December to March, especially during cold periods. The pool heater will help warm up the pool faster when it gets warmer outside, however you should not expect “bathtub temperatures” during or after Florida winter cold fronts. Disclaimer: We reserve the right to make pool heat unavailable at any time for maintenance or repairs. In case of a technical malfunction, we will refund the pool heat charge for the time the heat service was not available to you. No further credit will be given if pool equipment fails or is unavailable for any reason. We do not guarantee any specific temperature with pool heat service and no refunds can be provided. Understanding pool heat: The pool heater and circulation pump are usually running during daytime hours. Both are typically off at night. No water circulation or a red light at the equipment does NOT indicate any malfunction when the pump is off. Residential pool heaters are NOT run 24/7. Disclaimer: It is your responsibility to keep water level at the correct height between pool service visits. If water level gets too low (due to evaporation between pool service visits) the pool heater will NOT work. During times of low precipitation or when the pool water is heated and higher than ambient temperature, evaporation may lower the water level to a degree where the circulation pump is sucking air. The correct water level is for the water to be halfway up the skimmer inlet (the open square box). Fill with the provided garden hose. Insufficient water levels can damage the pool heater and the pool filter and may cause both to stop working. You can easily notice the noise change for a pool that does not contain sufficient water. The pool heat cannot be set higher than that maximum temperature (86°F) in order to keep chemicals balanced. If you want a “hot” pool use the SPA, as these smaller pieces are equipped for higher temperatures. Swimming pools are NOT intended for higher temperatures. Setting a pool to a higher temperature would trigger additional maintenance (bi-weekly pool service, increase in chemicals usage, increase in electricity) which are NOT included in the pool heat fee. IT IS VERY IMPORTANT THAT YOU NOT TOUCH ANY OF THE POOL EQUIPMENT. ONLY THE POOL SERVICE PROVIDER IS ALLOWED TO TOUCH THIS! Combined a spa/pool: If you would like to use the spa you will need to order pool heat otherwise, the spa won't heat up. During usage of the spa, the pool will not be heated. Switching between the pool/spa will trigger a protection pause for the heat pump. So using the spa will practically prevent the pool from being heating during that time. Since there is a pool automation system installed the temperature reading on the heat pump itself will not be accurate.

With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the private or community pool (including hot tubs) and patio areas.

Tenant hereby releases from liability and waives any and all claims that Tenant has or may have in the future against Sunset Properties, LLC, iTrip and their members, principals, agents, officers, employees, and representatives (collectively “Releasees”). Tenant acknowledges that if there is a pool and/or spa on the premises they have reserved include property, it poses a community pool risk to any and all guests on the undersigned agrees property. Tenant understands and acknowledges that the community pool use of other equipment (including Recreational Equipment as defined below) and patio/deck can be dangerous areasfacilities provided by Releasees and participation in outdoor activities, involves risks including, but not limited to the following: risk of property damage, bodily injury, including, but not limited to permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of Tenant or others, or from the unavailability of emergency medical care. Tenant is also aware that Xxxxxx’s stay at the Premises involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Premises during Tenant’s stay, and the condition of the property. Tenant understands that the deck/patio can be slippery when wet, description of the risks in this Agreement is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury may occur and or/death. Tenant understands and acknowledges that being in or near the ocean presents various risks and hazards, including strong currents, unexpected wave activity, floating debris and other potential hazards. Tenant assumes all such risks associated with being near or in the ocean. Tenant hereby agrees that if Tenant rents, operates or uses equipment, including but not limited to anyone who bikes, chairs, paddleboards, boogie boards, kayaks, floats, canopies, firepits, BBQ grills, umbrellas, toys or games (“Recreational Equipment”) provided by Releasees, Tenant does so at Tenant’s own risk. Xxxxxx agrees that Xxxxxx will inspect the Recreational Equipment and ensure that any defects are brought to Releasees’ attention. Tenant will also ensure that all measures are taken to prevent the Recreational Equipment from causing injury to Tenant or others. Xxxxxx agrees that Xxxxxx is not careful. With full knowledge voluntarily participating in all activities related to the rental, operation, or use of the above facts and warningsRecreational Equipment, the undersigned Tenant accepts and assumes all risk of injury, illness, damage or loss that might result, even if the risks involved to arise out of the negligence or fault of Releasees. Tenant agrees that Releasees shall not be liable for any damages arising from personal injuries Tenant or anyone under Xxxxxx’s custody, care, and control, sustain as a result of any and all of Tenant's guests in or activities related to the rental, operation, or use of Recreational Equipment provided by Releasees. Tenant assumes full responsibility for any such injuries or damages which may occur, and further agrees that Releasees shall not be liable for any loss or theft of personal property. Tenant specifically agrees that Releasees shall not be responsible for such injuries, damages, loss or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY Releasees whether such negligence is present at the private signing of this Agreement or community pool takes place in the future. This Waiver and Release does not apply to gross negligence or intentional torts by Releasees. Xxxxxx agrees to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from arise out of or be related in any way to Tenant’s rental and stay at the Premises or use of equipment including the Recreational Equipment. If any portion of this Agreement shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Agreement and the remainder of the Agreement shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. Xxxxxx agrees to defend, indemnify, and hold the Releasees harmless from and against all obligations, claims, damages, demands, penalties, liabilities, causes of action, costs and expenses of whatsoever kind, including, but not limited to, reasonable attorneys' fees and costs (including hot tubsthose incurred for experts), at both the trial and appellate levels (collectively “Claims”), imposed upon or incurred by or asserted against Releasees arising out of or relating to: (a) and patio areas.any accident or injury to, or death of, persons or loss of or damage to property occurring on or about the Premises or any portion thereof during Tenant’s rental term;
