Inclement Weather. 16.1 The parties are committed to working together to minimize the impact of inclement weather. The employer will ensure reasonable allowance is included in contracts taking into account historic weather conditions and forecast rainfall. 16.2 Inclement weather means the existence of rain or abnormal climatic conditions (whether hail, extreme cold, high wind, severe dust storm, extreme heat (as defined in clause 14), poor air quality (as defined in clause 15), or the like or any combination of these conditions) where it is not reasonable or it is unsafe for employees to continue working in those conditions. 16.3 The employer or its representative, when requested by the employees or their representative, must confer within a reasonable time (which does not exceed 60 minutes) for the purpose of determining whether or not the conditions referred to in clause 16.2 apply. 16.4 The time work stops due to inclement weather and the resumption of work after a period of inclement weather has ended will be recorded by the employer. 16.5 When inclement weather conditions exist, an affected employee is not required to start or continue to work where it is unreasonable or unsafe to do so. In cases where emergency work is required or it is necessary to complete a concrete pour already commenced to a practical stage, work may occur or continue provided that such work does not give rise to a reasonable concern on the part of an employee undertaking the work of an imminent risk to their health or safety. 16.6 Where emergency work or a concrete pour is completed in accordance with clause 16.5, work will be paid at the rate of 200% of the ordinary hourly rate calculated to the next hour, and in the case of wet weather, the employee will be provided with adequate wet weather gear. If an employee’s clothes become wet as a result of working in the rain the employee will be allowed to go home for the remainder of the day without loss of pay. 16.7 Where an employee is not able to perform any work at any location because of inclement weather, the employee will receive payment at the ordinary hourly rate for ordinary hours. Payment for time lost due to inclement weather is subject to a maximum of 32 hours pay in any 4-week period for each employee. Inclement Weather. 24.1 This Inclement Weather clause sets out the full rights, obligations and entitlements of the parties and establishes the conditions under which payment for periods of inclement weather shall be made. 24.2 This Inclement Weather clause is to be read and observed in lieu of the provisions of the award and VBIA. 24.3 Definition – inclement weather Inclement weather shall mean the existence of rain or abnormal climatic conditions (whether they be those of hail, snow, cold, high wind, severe dust storm, extreme high temperature or the like or any combination thereof) by virtue of which it is either not reasonable or not safe for employees exposed thereto to continue working whilst the same prevail.
Inclement Weather. 4:1 Employees who report for work on a workday or for prearranged work on a workday and are unable to work in the field because of inclement weather, heat or other causes, shall be paid for actual time worked, if any, but not less than two (2) hours at straight-time rates. The Company may require all or any employees to: • continue to work under cover or relocate to alternative work not affected by inclement weather provided there is dry access & egress to amenities; or • obtain materials and services for employees working undercover where there is only minimal exposure to inclement weather; or • when required, perform emergency and safety work or work on unexpected breakdowns which can be corrected in limited time duration; or • attend toolbox meetings, work planning sessions or skills development and/or training activities provided there is dry access and egress to amenities. Should only a portion of the project be affected by inclement weather, all other employees not so affected will continue working, notwithstanding that some employees may be entitled to cease work due to inclement weather. (c) Inclement Weather before Work is Started Where it is inclement from the usual start time for four hours, the Company may require all or any employees to: • remain in amenities provided there is dry access to other necessary amenities; or • continue to work under cover or relocate to alternative work not affected by inclement weather provided there is dry access & egress to amenities; or • obtain materials and services for employees working undercover where there is only minimal exposure to inclement weather; or • when required, perform emergency and safety work or work on unexpected breakdowns which can be corrected in limited time duration; or • attend toolbox meetings, work planning sessions or skills development and/or training activities provided there is dry access and egress to amenities. Inclement Weather. 13.1 The parties to this Agreement adopt the following provision for Inclement Weather - as follows: (i) should a portion of the project be affected, by inclement weather, all other employees not so affected will continue working in accordance with the appropriate award provisions, regardless that some employees may be entitled to cease work due to inclement weather. Inclement Weather. The Employer shall not arbitrarily or capriciously withhold approval of annual leave requested due to and during periods of severe inclement weather. When the Governor or his/her designee determines that inclement weather is severe enough to close or delay opening State offices, employees who are not already on leave and who are relieved of work due to such a determination, will not be charged leave for the period of closure. Employees who do report to work during periods of closure shall only be entitled to their normal rate of compensation and shall not receive additional leave or compensatory time.

Inclement Weather. When the University is in operation but an employee requests time off to deal with unanticipated problems related to natural disasters or severe weather conditions, the employee may charge the absence to accrued compensatory time, holiday credit, personal holiday, vacation time off, or leave without pay. Employees designated as essential must make all reasonable efforts to report to work as scheduled.
Inclement Weather. The safety and well-being of the employees shall be considered by the Employer at all times in deciding what work is to be performed during the inclement weather such as rain, snow, icing, severe cold or electrical storms. Employees who have reported to the job site reserve the right to refuse employment during inclement weather. No employee will be allowed to work more than sixteen (16) hours in any twenty-four (24) hour period without the consent of the Union’s Business Manager or designate. These sixteen (16) hours to include travel time.
Inclement Weather. When an employee reports to work and cannot work because of inclement weather they shall be paid two (2) hours reporting time and the employee must remain on the job for the two (2) hour period, unless otherwise instructed by the Employer’s supervisor. When an employee has commenced work and is instructed to stop due to inclement weather, they shall be paid for the actual time worked. In no case shall an employee receive less than two (2) hours pay.
