Sole Source of Funding. Amounts collected from utility customers pursuant to ORS 757.054, ORS 757.612, or the terms of a natural gas tariff that is in effect and that the PUC has directed to be paid to Energy Trust are the sole source of funding for this Agreement. Sole Source of Funding. Notwithstanding any other provision of this Agreement, the only source of funding for which the City is obligated to use to reimburse Developer for Developer’s obligations under this Agreement are PID Bond Proceeds in accordance with this Agreement and any future PID Reimbursement Agreements (or similar agreements), Assessments, and Impact Fee Credits. All other funding for Developer’s obligations under this Agreement shall be the sole responsibility of Developer.
Sole Source of Funding. The funding to pay COMCARE under the terms of the Agreement is limited to the funds USD 266 receives from the Commissioner of Education pursuant to the MOU, and payment to COMCARE will be made from no other USD 266 sources of funding. USD 266 will notify COMCARE as soon as USD 266 becomes aware that it will not receive funds from the Commissioner of Education pursuant to the MOU to pay COMCARE. COMCARE will not be obligated to provide services under this Agreement on and following the date it receives notice that funds are not available to pay COMCARE for services.

Additionally, Grantee understands that duplicative funding that cannot be re-programmed to support new or expanded grant-funded activities within the program’s scope may be de- obligated from this Grant Agreement/Contract and returned to System Agency.

  • Use of Funding 4.1 Unless otherwise provided in this Schedule B, the HSP shall use all Funding allocated for a particular Envelope only for the use or uses set out in the Applicable Policy.

  • Loss of Funding Performance by University under this Agreement may be dependent upon the appropriation and allotment of funds by the Texas State Legislature (Legislature) and/or allocation of funds by the Board of Regents of The University of Texas System (Board). If Legislature fails to appropriate or allot necessary funds, or Board fails to allocate necessary funds, then University will issue written notice to Contractor and University may terminate this Agreement without further duty or obligation. Contractor acknowledges that appropriation, allotment, and allocation of funds are beyond University’s control.

  • Sources of Funding A. State funding for dual credit/concurrent courses will be available to both the ISD and Hill College based upon the current agreement between the Commissioner of Education and Commissioner of Higher Education. In accordance with this agreement, Hill College may claim state funding for all students registered for college-level credit in a dual credit/concurrent course. The ISD may also claim full ADA funding for all students registered in a dual credit/concurrent course.
