These exceptions include the following: • Delivery to an area where the use of conventional material handling equipment is not feasible. • Delivery that requires opening cartons and stacking xxxxx on shelves. • Delivery that requires cartons to be carried up flights of stairs.

Special Inside Delivery. The Contractor may charge Customers a special Inside Delivery fee not to exceed $1.50 per case for the following circumstances: • Delivery to an area where the use of conventional delivery equipment, such as a dolly, hand truck, cart, or similar device is not feasible. • Delivery that requires opening cases and stacking xxxxx on shelves. • Delivery that requires cases to be carried up one or more full flights of stairs when an elevator or other mechanical device is unavailable. • Delivery that requires cases to be unloaded for security screenings and reloaded by the Contractor for delivery. In addition, the Contractor may charge Customer a special Inside Delivery fee not to exceed $1.75 per case if the Customer’s order requires special Inside Delivery where local ordinances prevent Contractor from utilizing delivery trucks on streets, or where the Contractor is required to engage a courier service instead of a common carrier for deliveries. The special Inside Delivery fee shall be assessed on a per occurrence basis and may be in the form of a flat fee, a fee per case, a fee per trip required by the delivery person, or other basis mutually agreed by the Customer upon issuance of the order. At no time shall the delivery fee exceed the per case limits established within this subsection. The Contractor shall provide the Customer requiring special Inside Delivery a fee estimate upon receipt of the Purchase Order. No additional fees may be applied for delivery.

  • PRODUCT DELIVERY Delivery must be made as ordered to the address specified on the Purchase Order and in accordance with the terms of the Contract or Contract Award Notice. Unless otherwise specified in the Bid Documents, delivery shall be made within thirty calendar days after receipt of a Purchase Order by the Contractor. The decision of the Commissioner as to compliance with delivery terms shall be final. The burden of proof for delay in receipt of Purchase Order shall rest with the Contractor. In all instances of a potential or actual delay in delivery, the Contractor shall immediately notify the Commissioner and the Authorized User, and confirm in writing the explanation of the delay, and take appropriate action to avoid any subsequent late deliveries. Any extension of time for delivery must be requested in writing by the Contractor and approved in writing by the Authorized User. Failure to meet such delivery time schedule may be grounds for cancellation of the order or, in the Commissioner’s discretion, the Contract.

  • Non Delivery C15.1 Where the Goods, having been placed in transit, fail to be delivered to the Authority on the due date for delivery, the Authority shall, (provided that the Authority has been advised in writing of the dispatch of the Goods), within ten (10) Working Days of the notified date of delivery, give notice to the Contractor that the Goods have not been delivered and may request the Contractor free of charge to deliver substitute Goods within the timescales specified by the Authority or terminate the Contract in accordance with clause C13.4 (Delivery).

  • Project Delivery Order Procedures The TIPS Member having approved and signed an interlocal agreement, or other TIPS Membership document, may make a request of the awarded Vendor under this Agreement when the TIPS Member desires goods or services awarded to the Vendor. Upon notification of a pending request, the awarded Vendor shall acknowledge the TIPS Member’s request as soon as possible, but must make contact with the TIPS Member within two working days.   • PRICE/DELIVERY Price(s) bid must be the price(s) for new goods, unless otherwise specified. Any bids containing modifying or “escalator” clauses will not be considered unless specifically requested in the bid specifications.

  • Shipping must be Freight On Board Destination to the delivery location designated on the Customer purchase order The Contractor will retain title and control of all goods until delivery is completed and the Customer has accepted the delivery. All risk of transportation and all related charges are the responsibility of the Contractor. The Contractor must file all claims for visible or concealed damage. Unless otherwise stated in the Agreement, deliveries must consist only of new and unused merchandise.

  • Delivery Location All Goods shall be delivered to the address specified in this Order (the "Delivery Location") during Buyer's normal business hours or as otherwise instructed by Buyer.
