Specified Equipment. 4.2.1 Subject to paragraph 4.2.3, the Train Operator has, in relation to a Service, a Firm Right to use any equipment registered with RSSB’s R2 system which has performance characteristics identical to or better than the Timing Load specified in the Rights Table for such Service.
4.2.2 Subject to paragraph 4.2.3, the Train Operator has, in relation to a Service, a Contingent Right to use any equipment registered with RSSB’s R2 system.
4.2.3 No rolling stock may be used unless and until it has achieved vehicle and route acceptance necessary for its use on the Network.
Specified Equipment. In order to provide the Services specified in this Schedule 5, subject to obtaining any necessary route clearance for the route in question, the Train Operator has:

4.2.2 Subject to paragraph 4.2.3, the Train Operator has, in relation to a Service, a Contingent Right to use any equipment registered with RSSB's R2 system.
4.2.3 No rolling stock may be used unless and until it has achieved vehicle and route acceptance necessary for its use on the CVL and in the case of electrified rolling stock, until the charges pursuant to Schedule 7 of this contract have been amended to include charges for electrified rolling stock.
Specified Equipment. 3.1 The Train Operator may only operate the Services if it does so using Specified Equipment.
3.2 The Train Operator shall, when making a Train Operator Variation Request, supply the information it is required to provide under Part D of the Network Code along with any other information which it considers may reasonably be required by Network Rail for the Train Operator Variation Request to be considered and accepted.
3.3 Network Rail, acting reasonably, shall promptly notify the Train Operator if, in respect of any Train Operator Variation Request, it requires any additional information as to the type and performance capability of the Specified Equipment to be operated by the Train Operator in order to enable Network Rail to carry out route investigations and timetable planning. The Train Operator shall duly provide any such information requested by Network Rail.
3.4 The Train Operator may, in making a Train Operator Variation Request to operate a Service under this contract, request to operate the maximum train length in metres which the relevant part of the Network can from time to time accommodate. Network Rail shall not unreasonably reject such request, subject to a right of Network Rail to vary the train length in cases where the Network cannot accommodate all requests to operate to the maximum length.
3.5 Nothing in paragraph 3.4 precludes the operation of trains in excess of platform lengths where appropriate measures have been taken to control, so far as is reasonably practicable, any risks introduced by the use of such longer trains.
Specified Equipment. 3.1 The Train Operator may only operate the Services if it does so using Specified Equipment.
3.2 The Train Operator shall, when making a Train Operator Variation Request, supply the information it is required to provide under Part D of the CVL Network Code along with any other information which it considers may reasonably be required by the CVL IM for the Train Operator Variation Request to be considered and accepted.
3.3 The CVL IM, acting reasonably, shall promptly notify the Train Operator if, in respect of any Train Operator Variation Request, it requires any additional information as to the type and performance capability of the Specified Equipment to be operated by the Train Operator in order to enable the CVL IM to carry out route investigations and timetable planning. The Train Operator shall duly provide any such information requested by the CVL IM.
Specified Equipment. In order to provide the Services specified in this Schedule 5, subject to obtaining any necessary route clearance for the Routes, the Train Operator has Firm Rights to operate the following railway vehicles: [List here all rolling stock to which Firm Rights are being given]. For the purposes of this Contract the railway vehicles specified in paragraph 5.1 are known as the "Specified Equipment".

4.2.2 Subject to paragraph 4.2.3, the Train Operator has, in relation to a Service, a Contingent Right to use any equipment registered with Network Rail’s rolling stock library.
4.2.3 No rolling stock may be used unless and until it has achieved vehicle and route acceptance necessary for its use on the Network.
Specified Equipment. Standard Equipment
3.1 The Train Operator has Firm Rights to use the Standard Specified Equipment set out below for providing Services:
(a) Class 373/1 Eurostar Intercapitals Units of a length no greater than 2 power cars and 18 trailer cars;
(b) Class 000/0 Xxxxxxxx Xxxxx xx Xxxxxx Units of a length no greater than 2 power cars and 14 trailer cars; and
(c) Class 374 Eurostar units of a length no greater than 16 coaches.
3.2 No Standard Specified Equipment may be used until and unless:
(a) the necessary route clearance has been obtained; and
(b) the necessary vehicle acceptance has been obtained.
3.3 The Additional Specified Equipment set out below may be used in an emergency and as a temporary measure only:
(a) Class 08 locomotives; and
(b) Match wagons provided that for the purpose of determining the maximum length of a Train, the length of the type of Additional Specified Equipment shall be added to the length of the rolling stock to which it is coupled.
3.4 No Additional Specified Equipment may be used until and unless the necessary route clearance has been obtained.
Specified Equipment. The Specified Equipment will include: diesel-powered locomotives suitable for haulage of the Services; and wagon types suitable for the carriage of Goods (including but not limited to coal, ore, bulk liquids, steel, containers, paper and pallets).
