Common use of Stage Payments Clause in Contracts

Stage Payments. 12.1. Contracts that extend across several months may be subject to stage payments. Where applicable, these are defined in the Contract. 12.2. Carbon Footprint shall have the right to suspend all work on behalf of the Client where the Client has not completed the Stage Payments on time to the agreed schedule. Any adverse impact that this suspension has upon the completion of the Contract for the Client shall be at the Client's sole responsibility. This right applies not just to the Contract in arrears but also any other contracts with the Client, whether or not payments against these contracts are in arrears. 12.3. When it has been agreed that payment of all or part of the Contract is to be made 'in advance', Carbon Footprint will not commence work on the Contract until the agreed payment is received from the Client in its entirety.
