Common use of Stolen or Damaged Property Clause in Contracts

Stolen or Damaged Property. A. Bargaining Unit members shall not be responsible for stolen, lost or damaged property, except where there is cause to suspect negligence or deliberate act. This shall include the use of credit cards or any other method of credit. In cases of Bargaining Unit members who are continuing their employment, no deduction in pay shall be made without ten (10) working days notice. If the Bargaining Unit members dispute the matter through the grievance procedure as applicable within the ten (10) working days notice, no deduction will be made until the dispute process has been completed. B. In cases of separating Bargaining Unit members, the Employer may withhold from the final paycheck the value of the lost or damaged property and may do so pending completion of the applicable dispute process. C. This section is not intended to preclude disciplinary action or provide for a time-frame for the action except as otherwise provided in this Agreement.
