Common use of SUBCOMMITTEE ON TECHNICAL BARRIERS TO TRADE Clause in Contracts

SUBCOMMITTEE ON TECHNICAL BARRIERS TO TRADE. 1. The Subcommittee on Technical Barriers to Trade established pursuant to Chapter 13 (Institutional Provisions) shall have the following functions: (a) working in order to facilitate implementation of this Chapter and cooperation between the Parties in all matters pertaining to this Chapter; (b) monitoring the implementation, enforcement and administration of this Chapter; (c) promptly addressing any issue that a Party raises related to the development, adoption, application or enforcement of standards, technical regulations, or conformity assessment procedures; (d) improving joint cooperation between the Parties in the areas mentioned in Article 753 (e) conducting negotiations for mutual recognition agreements; (f) exchanging information, at a Party's request, on standards, technical regulations, and conformity assessment procedures, including the Parties' respective views regarding non-Party issues; (g) exchanging information on developments in non-governmental, regional and multilateral fora engaged in activities related to standards, technical regulations and conformity assessment procedures; (h) consulting, at a Party's written request, with the aim of solving any matter arising under this Chapter within a reasonable period of time; (i) reviewing this Chapter in light of any developments under the TBT Committee and, if necessary, developing recommendations for amendments to this Chapter; (j) establishing issue or sector-specific ad hoc working groups, if necessary to achieve the objectives of this Chapter; and (k) taking any other steps that the Parties consider will assist them in implementing this Chapter. 2. The Subcommittee shall meet upon request of a Party. Meetings may be conducted in person, via teleconference, videoconference, or any other means as mutually determined by the Parties. 3. In a dispute on matters covered by this Chapter, consultations pursuant to paragraph 1(h) shall be mandatory in order to activate the procedures provided in Chapter 12 (Dispute Settlement). 4. The contact points set out in Annex 7-A shall be responsible for coordinating with the relevant authorities and persons in their respective countries as well as ensuring that such authorities and persons are in contact.

The functions of the TBT Sub-Committee shall have the following functionsbe: (a) working in order to facilitate monitoring the implementation of this Chapter and cooperation between the Parties in all matters pertaining to this Chapter;Chapter; (b) monitoring the implementation, enforcement and administration of this Chapter;coordinating technical cooperation activities; (c) promptly addressing any issue that a Party raises related facilitating technical consultations pursuant to the development, adoption, application or enforcement of standards, technical regulations, or conformity assessment proceduresArticle 6.8; (d) improving joint cooperation between the Parties in the areas mentioned in Article 753identifying sectors for enhanced cooperation, including giving favourable consideration to any sector-specific proposal made by either Party; (e) conducting negotiations for mutual recognition agreements;establishing dialogues between regulators in accordance with the objectives of this Chapter; (f) exchanging information, at a Party's request, on standards, technical regulations, and conformity assessment procedures, including the Parties' respective views regarding non-Party issues;initiating side agreements where appropriate pursuant to Article 6.9; (g) exchanging information on developments in non-governmental, regional and multilateral fora engaged in activities related coordinating the implementation of side agreements pursuant to standards, technical regulations and conformity assessment procedures;6.9; (h) consulting, at a Party's written request, with the aim consulting on any issue prior to meetings of solving any matter arising under this Chapter within a reasonable period of time;relevant international organisations if appropriate; (i) reviewing this Chapter in light of any developments under other functions mutually agreed by the TBT Committee and, if necessary, developing recommendations for amendments to this Chapter;Parties;and (j) establishing issue or sector-specific ad hoc working groups, if necessary carrying out other tasks assigned to achieve the objectives of this Chapter; and (k) taking any other steps that the Parties consider will assist them in implementing this Chapter. 2. The Subcommittee shall meet upon request of a Party. Meetings may be conducted in person, via teleconference, videoconference, or any other means as mutually determined it by the PartiesJointCommittee. 3. In a dispute on matters covered by this Chapter, consultations pursuant to paragraph 1(h) The TBT SubCommittee shall be mandatory in order to activate cochaired and meet once a year, unless otherwise agreed by the procedures provided in Chapter 12 (Dispute Settlement)Parties. The TBT SubCommittee meetings may be conducted by any agreed method on a case by case basis and may be combined with those of the SubCommittee on Sanitary and Phytosanitary Measures established under Article 7.9. 4. The TBT SubCommittee shall keep up to date a work programme and keep track of its activities. 5. The TBT SubCommittee may establish ad hoc working groups to accomplish specific tasks. 6. The TBT Sub-Committee shall report on its work to the JointCommittee. 7. The contact points set out referred to in Annex 7-A Article 6.11 shall be responsible for coordinating setting the agenda and organising the meetings. The TBT Sub-Committee shall include representatives of the authorities of each Party with expertise in the areas to be discussed. 8. Upon agreement, the Parties may invite representatives from industry, business associations or other relevant authorities and persons organisations to participate in their respective countries as well as ensuring that such authorities and persons are in contactparts of the meetings of the TBT Sub-Committee on a case by case basis.

The Subcommittee may meet in person, via teleconference, via video-conference or through any other means, as agreed by the Parties. 2. The functions of the Subcommittee shall have the following functionsinclude: (a) working in order to facilitate implementation of this Chapter and cooperation between the Parties in all matters pertaining to this Chapter; (b) monitoring the implementation, enforcement implementation and administration of this Chapter; (b) enhancing cooperation in the development and improvement of standards, technical regulations, and conformity assessment procedures; (c) ensuring appropriate steps are taken promptly addressing to address any issue that a Party raises may raise related to the development, adoption, application application, or enforcement of standards, technical regulations, regulations or conformity assessment procedures; (d) improving joint considering any sector-specific proposal a Party makes for further cooperation between the Parties regulatory authorities, accreditation bodies or conformity assessment bodies, including, where appropriate, between governmental and non-governmental conformity assessment bodies located in the areas mentioned in Article 753each Party's territory; (e) conducting negotiations considering a request that a Party recognises the results of conformity assessment procedures conducted by bodies in the other Party’s territory, including a request for mutual recognition agreementsthe negotiation of an agreement, in a sector proposed by that other Party; (f) exchanging information, at a Party's request, on standards, technical regulations, and conformity assessment procedures, including the Parties' respective views regarding non-Party issues; (g) exchanging information on developments in non-governmental, regional regional, and multilateral fora engaged in activities related to standards, technical regulations regulations, and conformity assessment procedures; (hg) consultingon the request of the other Party, at a Party's written request, with the aim of solving promptly facilitating technical discussions on any matter arising under this Chapter, which shall be without prejudice to the rights and obligations of the Parties under Chapter within a reasonable period 10 (Dispute Settlement); (h) taking any other steps the Parties consider will enhance their implementation of timethe TBT Agreement and facilitate trade in goods between them; (i) reviewing this Chapter in light of any developments under the TBT Committee andAgreement, if necessary, and developing recommendations for amendments to this the Chapter;, in light of those developments; and (j) establishing issue or sector-working groups to undertake specific ad hoc working groups, if necessary to achieve the objectives of this Chapter; and (k) taking any other steps that the Parties consider will assist them in implementing tasks under this Chapter. 23. The Subcommittee shall meet upon request within one year of a Party. Meetings may be conducted in person, via teleconference, videoconferenceentry into force of this Agreement, or any other means as at times mutually determined agreed by the Parties. 3. In a dispute on matters covered by this Chapter, consultations pursuant to paragraph 1(h) shall be mandatory in order to activate the procedures provided in Chapter 12 (Dispute Settlement). 4. The contact points set out in Annex 7-A shall be responsible for coordinating with the relevant authorities and persons in their respective countries as well as ensuring that such authorities and persons are in contact.
