Common use of Subcontractor Warranties Clause in Contracts

Subcontractor Warranties. Contractor shall be responsible for enforcing the warranties of all Subcontractors through the Warranty Period unless Owner requests that any such warranties be assigned to it at an earlier date. At the end of the Warranty Period, Contractor will assign to Owner its rights under any and all such Subcontractor warranties that continue past the end of the Warranty Period, including the Major Equipment Warranties. Contractor will secure such assignment from each Subcontractor, and Contractor will deliver to Owner copies of all Subcontracts providing for warranties enforceable by Owner. Contractor will not, and Contractor will ensure that Contractor’s Personnel do not, take any action which could release, void, impair or waive any Subcontractor warranties. Contractor shall provide reasonable assistance to Owner without cost to Contractor in connection with the enforcement by Owner of any Subcontractor warranty after such assignment provided those warranties are in are excess of those set forth in Section 7.1.
