Common use of Subpoenaed Records Clause in Contracts

Subpoenaed Records. If a court of competent jurisdiction subpoenas a bargaining unit member’s official personnel record in conjunction with a lawsuit in which the Employer believes the bargaining unit member’s conduct was within the scope of his or her authority and did not constitute willful misconduct or gross negligence as outlined in Article 36, the Employer agrees to make a good faith effort to notify the bargaining unit member, unless prohibited by law.
