Subrogation recoveries. BlueCross will enforce Employer’s subrogation rights; as consideration for this service, it will receive a fee of Fifteen (15%) percent the recovery from each subrogation case. Employer will be responsible for: ● Any outside attorneys’ fees incurred in enforcing the Plan’s subrogation rights; and ● Other expenses arising in connection with litigation to enforce its subrogation interest, including, but not limited to, court costs, discovery expenses and expert witness fees. BlueCross will obtain Employer’s approval before incurring any expert witness fees or expenses. Employer will advance said expenses if required in the preparation of its case(s) for trial. Once a subrogation case has been finalized, and BlueCross has received the money, it will deduct its fee, the attorneys’ fee (if any) and any other litigation expenses from the recovery. The remaining amount is the net recovery, and the net recovery will be credited on Xxxxxxxx’s next claims invoice.

Subrogation recoveries. 1.1.1 BlueCross will enforce Employer’s subrogation rights. For all subrogation recoveries received on or after July 1, 2022, BlueCross will retain a fee of 39% of the gross subrogation recovery. Employer is responsible for payment of: (a) any outside attorneys’ fees incurred in enforcing Employer’s subrogation rights; and (b) any other expenses arising in connection with litigation to enforce its subrogation interest, including, but not limited to, court costs and discovery expenses.
Subrogation recoveries. Sedgwick shall pursue subrogation and Second Injury Fund recoveries as appropriate and all subrogation/recovery cases will be handled by our centralized recovery unit. Client shall pay Sedgwick fifteen percent (15%) of the recovery received. All fees and expenses, including attorneys’ fees or investigations, for pursuit of any recovery shall be charged to the appropriate Qualified Claim file as an allocated loss adjustment expense. Upon receipt of the recovery check, Sedgwick shall deposit such checks and issue payment from its Accounts Payable system to Client for the net recovery (less Sedgwick’ fee). The net recovery check will be deposited into the Client owned bank account (when one exists) or forwarded directly to Client.
Subrogation recoveries. From and after the Closing Date, if the Company receives a subrogation recovery in respect of a Reinsured Claim liability, the Company shall pay the Reinsurer an amount equal to the net recovery proceeds within thirty days of receipt.
Subrogation recoveries. If Subordinated Agent or any Subordinated Creditor pays or distributes cash, property, or other assets to Senior Lender under this Agreement, the Subordinated Agent or applicable Subordinated Creditor will be subrogated to the rights of the Senior Lender with respect to the value of the payment or distribution. If Senior Lender is required to disgorge any proceeds of Collateral, payment or other amount received by such Person (whether because such proceeds, payment or other amount is invalidated, declared to be fraudulent or preferential or otherwise) or turn over or otherwise pay any amount (a “Recovery”) to the estate or to any creditor or representative of an Obligor or any other Person, then the Senior Debt shall be reinstated (to the extent of such Recovery) as if such Senior Debt had never been paid. A distribution made pursuant to this Agreement to Senior Lender which otherwise would have been made to any Subordinated Creditor is not, as between the Obligors and such Subordinated Creditor, a payment by any Obligor to or on account of the Senior Debt.
