Common use of Subsequent Application Clause in Contracts

Subsequent Application. In the event ACCESS Integrated or ACCESS Integrated’s Guest(s) desires to modify its use of the Collocation Space after a BFFO, ACCESS Integrated shall complete an application that contains all of the detailed information associated with a requested Alteration of the Collocation Space, as defined in Section 5.15 above (Subsequent Application). The Subsequent Application will be considered Bona Fide when it is complete and accurate, meaning that all of the required fields on the Subsequent Application have been completed with the appropriate type of information associated with the requested Alteration. BellSouth shall determine what modifications, if any, to the BellSouth Premises are required to accommodate the change(s) requested by ACCESS Integrated in the Subsequent Application. Such modifications to the BellSouth Premises may include, but are not limited to, floor loading changes, changes necessary to meet HVAC requirements, changes to power plant requirements, equipment additions, etc.

In the event ACCESS Integrated Neutral Tandem or ACCESS IntegratedNeutral Tandem’s Guest(s) desires to modify its use of the Collocation Space in a Central Office after a BFFO, ACCESS Integrated Neutral Tandem shall complete an application that contains all of the detailed information associated with a requested Alteration of the Collocation Space, as defined in Section 5.15 above (Subsequent Application). The Subsequent Application will be considered Bona Fide when it is complete and accurate, meaning that all of the required fields on the Subsequent Application have been completed with the appropriate type of information associated with the requested Alteration. BellSouth shall determine what modifications, if any, to the BellSouth Premises are required to accommodate the change(s) requested by ACCESS Integrated Neutral Tandem in the Subsequent Application. Such modifications to the BellSouth Premises may include, but are not limited to, floor loading changes, changes necessary to meet HVAC requirements, changes to power plant requirements, equipment additions, etc.

The Subsequent Application will be considered Bona Fide when it is complete and accurate, meaning that all of the required fields on the Subsequent Application have been are completed with the appropriate type of information associated with the requested Alteration. BellSouth shall determine what modifications, if any, to the BellSouth Premises are required to accommodate the change(s) change requested by ACCESS Integrated PTLLC in the Subsequent Application. In the event ACCESS Integrated ALCALL or ACCESS IntegratedALCALL’s Guest(s) desires to modify its use of the Collocation Space after a BFFO, ACCESS Integrated ALCALL shall complete an application (Subsequent Application) that contains all of the detailed information associated with a requested Alteration of the alteration related to the Collocation Space, as defined in Section 5.15 above (Subsequent Application)5.13 of this Attachment. The Subsequent Application will be considered Bona Fide when it is complete and accurate, meaning that all of the required fields on the Subsequent Application have been are completed with the appropriate type of information associated with the requested Alterationalteration. BellSouth shall determine what modifications, if any, to the “BellSouth Premises Premises” are required to accommodate the change(s) change requested by ACCESS Integrated ALCALL in the Subsequent Applicationapplication. Such modifications to the “BellSouth Premises Premises” may include, but are not limited to, floor loading changes, changes necessary to meet HVAC requirements, changes to power plant requirements, equipment additions, etc.
