Summary of Citation and Fine Process. A violation of the MLS Rules may be reported by way of an “Error Report” form, direct member report, use of citation manager software or staff investigation. If the violation is one that can be corrected, the MLS shall send a Notice of Violation-Warning (NV-W) to the violating individual (“Violator”), and a copy will be sent to the responsible Broker Participant (“Responsible Participant”), and /or Office Manager. In accordance with MLS rules it is the responsibility of the users to maintain valid e-mail addresses on the system, and delivery to an e-mail is sufficient notice. Violators must correct the violation outlined in the NV-W in the time specified in the NV-W. If the violation is not corrected by the deadline specified in the NV-W the MLS sends a Notice of Violation and Fine Assessment (NVFA) to the Violator and a copy of the Notice to the Responsible Participant and/or Sales Manager. If the violation of the MLS Rules is one that cannot be corrected, an NV-W is not sent to the Violator and Responsible Participant. Instead, the NVFA will be sent to the Violator (with a copy to the Responsible Participant and/or Sales Manager). If, within twenty (20) calendar days of the Receipt Date of Notice of Violation and Fine Assessment (NVFA), the fine is not paid or a Request for Hearing (RH) with a $300 filing fee is not received, the MLS privileges of the Violator and/or the Responsible Participant will be suspended. In the event of a suspension, services will not be restored until the fine has been paid and the offense is corrected (if it is one that can be corrected).
