SUMMARY OF THE CLAIMS AND THE LITIGATION. 22 The named Plaintiffs in this action are the Los Angeles Police Protective League, 23 Xxxx Xxx, Xxxxxxxx Xxxxxxx, Xxxxx Xxxxxx, Xxxxx Xxxxxx, and Xxxxxx Xxxx. The 24 certified Class under FRCP 23(B)1(a) was defined by Judge Xxxx as: those officers who 25 have already received a “Xxxxx” letter and those who actually receive such a letter during 26 the course of this litigation and whose substantive claims would not be barred by the 27 applicable statute of limitations. The Plaintiffs alleged several causes of action based on 28 federal and California State constitutional provisions and state law. The first four claims 1 allege violations of 42 USC § 1983. The fifth claim alleges a violation of Cal.Gov.Code 2 Sections 3300, et seq. (The Public Safety Officers’ Procedural Xxxx of Rights Act). The 3 sixth alleges a violation of the California Constitution. The seventh seeks declaratory relief, 4 and the eighth, injunctive relief. Plaintiffs assert that Defendants’ policy deprives officers 5 of property interests without due process because: 1) the City Charter and other provisions 6 create entitlement in officer positions and pay; 2) officer reassignments pursuant to “Xxxxx” 7 letters result in pay and benefit reductions, such as the loss of a patrol bonus and skill or 8 merit pay; and 3) Defendants do not permit officers to appeal the reassignments 10 Government Code Section 3304(b) by failing and refusing to provide Plaintiffs with an 11 administrative appeal from alleged punitive action imposed by the “Xxxxx” letters.

  • Claims and Suits (a) The Receiver shall have the right, in its discretion, to (i) defend or settle any claim or suit against the Assuming Bank with respect to which the Receiver has indemnified the Assuming Bank in the same manner and to the same extent as provided in Article XII, and (ii) defend or settle any claim or suit against the Assuming Bank with respect to any Liability Assumed, which claim or suit may result in a loss to the Receiver arising out of or related to this Agreement, or which existed against the Failed Bank on or before Bank Closing. The exercise by the Receiver of any rights under this Section 9.3(a) shall not release the Assuming Bank with respect to any of its obligations under this Agreement.

  • Claims and Disputes A. Claims by CONTRACTOR shall be made in writing to the COUNTY within two (2) business days after the commencement of the event giving rise to such claim or CONTRACTOR shall be deemed to have waived the claim.   • Pending Litigation Financial position and prospective long-term profitability of the Single Tenderer, and in the case the Tenderer is a JV, of each member of the JV, shall remain sound according to criteria established with respect to Financial Capability under paragraph I (i) above assuming that all pending litigation will be resolved against the Tenderer. Tenderer shall provide information on pending litigations as per Form CON-2.
