SURRENDER OF LICENSED AREA. Immediately following Licensee's use, Licensee shall, at Licensee's sole cost and expense, remove any and all equipment installed by Licensee, repair any and all damage caused by the removal of said equipment, clean or cause to be cleaned the Licensed Area and place the Licensed Area in at least as clean a condition as when Licensee's use commenced. All ashes, rubbish, garbage and other waste shall be disposed of in a sanitary and safe manner. In the event Licensee's repair or clean-up is not reasonably satisfactory to Owner or performed in a timely manner, Owner shall repair or clean the Licensed Area at the sole cost and expense of Licensee. Licensee agrees to reimburse Landlord for such costs upon receipt of Landlord's invoice.
SURRENDER OF LICENSED AREA. Licensee shall be responsible to restore the Licensed Area to the same condition in which it was originally provided by Licensor, ordinary wear and tear excepted and with all of Licensee’s personal property, trade fixtures, goods and effects removed. Licensee agrees that all personal property remaining within the Licensed Area after Licensor takes possession of the Licensed Area is conclusively deemed to be abandoned by Licensee and the property of Licensor. Licensee waives its rights, if any, under any statutes or other legal doctrines requiring Licensor to remove, store, return or auction such property, and Licensor may dispose of such property as it sees fit, free of any claims of Licensee or others claiming through Licensee. Licensee shall make all necessary repairs to areas damaged as a result of its use of the Licensed Area including, but not limited to, the landscaping and parking lot. Following the date Licensee vacates the Licensed Area, Licensor shall have the right to perform a final inspection of the Licensed Area and the Shopping Center. If Licensor determines that any remedial action is required to restore the Licensed Area or any portion of the Shopping Center to substantially the same condition that existed prior to Licensee’s occupancy of the Licensed Area, Licensee shall complete such remedial action within ten (10) days from Licensee’s receipt of Licensor’s final report.
SURRENDER OF LICENSED AREA. 27.1 The voluntary or other surrender of this License by Licensee, or a mutual cancellation thereof, shall not work a merger. On the last day, or sooner termination, of this License, Licensee shall quit and surrender, in good condition and repair (ordinary wear and tear excepted), the Licensed Area and all alterations, additions, improvements and betterments which may have been made in or to the Licensed Area, except: (i) movable and unattached furniture and trade fixtures installed at the expense of Licensee; and (ii) such other property, if any, which Licensee is expressly authorized in writing by Director to remove from the Licensed Area.
