Suspension of unsafe Construction Works. 13.5.1 Upon recommendation of the Independent Engineer to this effect, the Lead ULB may, by notice, require the Concessionaire to suspend forthwith the whole or any part of the Construction Work if, in the reasonable opinion of the Lead ULB, such work is unsafe and potential safety hazard. 13.5.2 The Concessionaire shall, pursuant to notice under Clause 13.5.1, suspend the Construction Works or any part thereof for such time and in such manner as may be specified by the Participating ULBs and thereupon carry out remedial measure to secure the safety of suspended works. The Concessionaire may by notice require the Independent Engineer to inspect such remedial measure forthwith and make a report to the Lead ULB recommending whether or not such suspension hereunder may be revoked. Upon receiving the recommendations of the Independent Engineer, the Lead ULB shall either revoke such suspension or instruct the Concessionaire to carry out such other and further remedial measures as may be necessary in the reasonable opinion of the Lead ULB, and the procedure set forth in Clause 13.5.1 shall be repeated until the suspension hereunder is revoked.
