Payment for Change of Scope. Payment for Change of Scope shall be made in accordance with the payment schedule specified in the Change of Scope Order.
Payment for Change of Scope. 16.3.1 Within 7 (seven) days of issuing a Change of Scope Order, the Authority shall make an advance payment to the Concessionaire in a sum equal to 20% (twenty per cent) of the cost of Change of Scope as agreed hereunder, and in the event of a Dispute, 20% (twenty per cent) of the cost assessed by the Independent Engineer. The Concessionaire shall, after commencement of work, present to the Authority bills for payment in respect of the works in progress or completed works, as the case may be, supported by such Documentation as is reasonably sufficient for the Authority to determine the accuracy thereof. Within 30 (thirty) days of receipt of such bills, the Authority shall disburse to the Concessionaire such amounts as are certified by the Independent Engineer as reasonable and after making a proportionate deduction for the advance payment made hereunder, and in the event of any Dispute, final adjustments thereto shall be made under and in accordance with the Dispute Resolution Procedure.
16.3.2 Notwithstanding anything to the contrary contained in Clause 16.3.1, all costs arising out of any Change of Scope Order issued during the Construction Period shall be borne by the Concessionaire, subject to an aggregate ceiling of 0.25% (zero point two five per cent) of the Total Project Cost. Any costs in excess of the ceiling shall be reimbursed by the Authority in accordance with Clause 16.3.
1. In the event that the total cost arising out of Change of Scope Orders (if any) issued prior to the Project Completion Date is less than 0.25% (zero point two five per cent) of the Total Project Cost, the difference thereof shall be credited by the Concessionaire to the Safety Fund within a period of 180 (one hundred and eighty) days of the Project Completion Date. For the avoidance of doubt, it is agreed that the aforesaid 0.25% (zero point two five per cent) of the Total Project Cost shall, to the extent borne by the Concessionaire, be deemed to form part of the actual capital cost of the Project.
Payment for Change of Scope. The Concessionaire shall, after commencement of work, present to the Authority bills for payment in respect of the works in progress or completed works, as the case may be, supported by such Documentation as is reasonably sufficient for the Authority to determine the accuracy thereof. Within 30 (thirty) days of receipt of such bills, the Authority shall disburse to the Concessionaire 50% (fifty per cent) of such amounts as are certified by the Independent Engineer or the Monitoring Agency, as the case may be, as reasonable and after making a proportionate deduction for the advance payment made hereunder, and in the event of any Dispute, final adjustments thereto shall be made under and in accordance with the Dispute Resolution Procedure.
16.3.2 Notwithstanding anything to the contrary contained in Clause 16.3.1, all costs arising out of any Change of Scope Order issued during the Construction Period shall be borne by the Concessionaire, subject to an aggregate ceiling of 0.25% (zero point two five per cent) of the Total Project Cost. Any costs in excess of the ceiling shall be reimbursed by the Authority in accordance with Clause 16.3.1.

Within 30 (thirty) days of receipt of such bills, the Authority shall disburse to the Concessionaire 50% (fifty per cent) of such amounts as are certified by the Independent Engineer or the Independent Panel, as the case may be, as reasonable and after making a proportionate deduction for the advance payment made hereunder, and in the event of any Dispute, final adjustments thereto shall be made under and in accordance with the Dispute Resolution Procedure.
Payment for Change of Scope. 15.3.1 Within [15 (fifteen)] days of issuing a Change of Scope Order relating to Maintenance Depots, the Authority shall make a part payment to the Operator in a sum equal to [20% (twenty per cent)] of the cost of Change of Scope as agreed hereunder upon furnishing of a bank guarantee by the Operator for an equivalent amount and for a period of [180 (one hundred and eighty)] days, substantially in the form specified in Schedule-D. The Operator shall, after commencement of work, present to the Authority bills for payment in respect of the works and services in progress or completed works and services, as the case may be, supported by such Documentation as is reasonably sufficient for the Authority to determine the accuracy thereof. Within [30 (thirty)] days of receipt of such bills, the Authority shall disburse to the Operator such amounts as are reasonable and after making a proportionate deduction for the advance payment made hereunder, and in the event of any Dispute, final adjustments thereto shall be made under and in accordance with the Dispute Resolution Procedure.
15.3.2 Notwithstanding anything to the contrary contained in Clause 15.3.1, all costs arising out of any Change of Scope Order shall be borne by the Operator, subject to an aggregate ceiling of 0.25% (zero point two five per cent) of the Total Project Cost. Any costs in excess of the ceiling shall be reimbursed by the Authority in accordance with Clause 15.3.1.
Payment for Change of Scope. 21.5.1 The cost of procurement of Bus under the Change of Scope Order over and above the amount in the invoice as submitted by Operator in accordance with provisions of Clause 12.1.2 shall be borne by the Authority. For clarification the Operator will bear the cost of procurement of Bus up to the amount in the invoice as submitted by Operator in accordance with provisions of Clause 12.1.2;
21.5.2 The rate of O&M Fee applicable in respect of the period when the Change of Scope Order is issued shall be the O&M Fee as specified in Schedule XIX. However, this O&M Fee shall be revised by increasing the capex component in O&M Fee by the same percent by which the cost of bus has gone up, fuel component in O&M Fee shall be varied by the same percent factor by which the bus mileage varies. The bus mileage values provided by Bus Manufacturer shall be used for reference;
21.5.3 In the event, the cost towards procurement of additional Buses under the Change of Scope Order, is borne by the Operator, upon Termination or Expiry, as the case may be, the Operator shall be entitled to receive from the Authority, Asset Transfer Value, subject to the following:
i. The Authority shall be under an obligation to take possession of the Buses that are less than [4 (four)] years of age and have plied up to 360,000 kms;
ii. The Authority shall have an option to take possession of the Buses that are more than [4 (four)] years of age.

The Concessionaire shall, after commencement of work, present to the Authority bills for payment in respect of the works in progress or completed works, as the case may be, supported by such Documentation as is reasonably sufficient for the Authority to determine the accuracy thereof. Within 30 (thirty) days of receipt of such bills, the Authority shall disburse to the Concessionaire such amounts as are certified by the Independent Monitor as reasonable and after making a proportionate deduction for the advance payment made hereunder, and in the event of any Dispute, final adjustments thereto shall be made under and in accordance with the Dispute Resolution Procedure.
15.3.2 Notwithstanding anything to the contrary contained in Clause 15.3.1, all costs arising out of any Change of Scope Order issued during the Concession Period shall be borne by the Concessionaire, subject to an aggregate ceiling of [0.25% (zero point two five per cent) of the Total Project Cost]. Any costs in excess of the ceiling shall be reimbursed by the Authority in accordance with Clause 15.3.1.
Payment for Change of Scope. Pursuant to the issuance of the Change of Scope Order, the Mine Operator shall, after commencement of work, present to the Authority GST invoice/ debit note/ credit note for payment/recovery in respect of the works and services in progress or completed works and services, as the case may be, supported by such Documentation as is reasonably sufficient for the Authority to determine the accuracy thereof. In the event the Change of Scope Order results in alteration of costs, the Mine Operator shall raise GST invoice/ debit note/ credit note to reflect such additional/reduced cost incurred by it, along with the necessary supporting Documentation (as is reasonably sufficient for the Authority to determine the accuracy thereof), which shall be in line with the cost estimate provided by the Mine Operate or pursuant to Clause 15.2.2(b). Within 30 (thirty) days of receipt of such bills, along with the necessary supporting Documentationthe Authority shall disburse to the Mine Operator such additional/reduced amounts as is evidenced in the GST invoice/debit note/ credit note raised by the Mine Operator. The Mine Operator hereby undertakes to pay, within 30 (thirty) days of the Change of Scope Order, any amount that may be payable by the Mine Operator to the Authority (in accordance with the Change of Scope Order) due to reduction in the Scope of the Project. In the event of any Dispute, final adjustments thereto shall be made under and in accordance with the Dispute Resolution Procedure.
