Common use of Systems Warranty and Service and Maintenance Agreements Clause in Contracts

Systems Warranty and Service and Maintenance Agreements. EndoSonics shall make available to purchasers of the Systems its standard warranty as stipulated in Exhibit D. Such warranty for the first year after delivery shall be included in the purchase price of the Systems. EndoSonics shall make an annual extended service and maintenance agreement available, substantially in the form set forth in Exhibit E, exclusively through Distributor in the Territory as from the first year after delivery of the Systems. Distributor shall purchase such annual service and maintenance agreement for each of the Systems to which it retains title in the Territory at a cost set forth in Exhibit A.
