Common use of Taking Personal Clause in Contracts

Taking Personal. Carer’s Leave (a) An employee may take paid personal/xxxxx’s leave if the leave is taken: (i) because the employee is not fit for work because of a personal illness, or personal injury, affecting the employee; or (ii) to provide care or support to a member of the employee’s immediate family, or a member of the employee’s household, who requires care or support because of: (A) a personal illness, or personal injury, affecting the member; or (B) an unexpected emergency affecting the member; or (iii) for their emotional recovery following a traumatic event. (b) If the employee has exhausted his or her entitlement under subclause 4(a), the employee may take up to an additional two (2) days unpaid personal/carer’s leave each time the employee needs to care for and support members of the employee’s immediate family or household who requires care and support for a reason specified in subclause 4(a)(ii). (c) The employee may take additional unpaid carer’s leave if the employer agrees. (d) An employee cannot take personal/carer’s leave if another person has taken leave to care for the same person unless there are special circumstances requiring more than one (1) person to care for the person. (e) Personal/xxxxx’s leave may be taken for part of a day. (f) In this clause: (i) “employee” does not include a casual employee. (ii) “personal/xxxxx’s leave” includes sick personal/xxxxx’s leave accrued before the commencement of this clause.
