Grantee will construct and maintain its Cable System using applicable City codes and the following safety codes and construction standards: NEC - NATIONAL ELECTRICAL CODE; NESC - NATIONAL ELECTRICAL SAFETY CODE; OSHA - OCCUPATIONAL SAFETY AND HEALTH ACT; WISHA - WASHINGTON INDUSTRIAL SAFETY AND HEALTH ACT. Nothing herein shall preclude Grantee from raising any and all defenses it may have under applicable codes, including the argument that its Cable System may be grandfathered under prior provisions of applicable codes.
