Term Appointment. (i) An employee who is employed continuously in an assignment of work that is anticipated to be or turns out to be thirty-nine (39) weeks or more (ie. one thousand three hundred and sixty-five (1,365) hours) but less than one hundred and four (104) weeks (ie. three thousand six hundred and forty (3,640) hours) shall be appointed as a Term Employee. (ii) Notwithstanding (i) where an employee has been employed continuously in a regularly scheduled part time position, in an assignment of work that is anticipated to be or turns out to be thirty-nine (39) weeks or more but less than one hundred and four (104) continuous weeks shall be appointed as a Part Time Term Employee. (b) Notwithstanding (a), where the Employer has funding from a third party which will support a specific project for a term of more than two (2) years, the Employer may appoint an employee for the term of the funding to a maximum of three (3) years. If the term appointment exceeds three (3) years, the Employer shall change the status of the employee appointed to that position from term to permanent, upon the completion of more than three
Term Appointment. (a) The Company hereby appoints Consultant to render those services as more specifically described in Section 2 hereof for the term of this Agreement. (b) Unless terminated at an earlier date in accordance with Section 6 of this Agreement or otherwise extended by agreement of the parties, the term of the Consultant’s engagement hereunder shall be for a period of two (2) years (the “Term”), commencing on the Effective Date. The period of engagement may be extended by written agreement or e-mail between the parties, provided that certain provisions relating to compensation may change upon commencement of any extension hereto.

Term Appointment. (a) The Company hereby appoints Consultant to render those services as more specifically described in Section 2 hereof for the term of this Agreement. (b) Unless terminated at an earlier date in accordance with Section 6 of this Agreement or otherwise extended by agreement of the parties, the term of Consultant’s engagement with the Company shall be for an initial term of one (1) year (the “Initial Term”), commencing on the date hereof and shall continue thereafter until ended in accordance with this Agreement. In the absence of a Notice of Termination, as provided herein, this Agreement shall renew automatically on the anniversary date hereof, on a year by year term, for each of the successive two years (“Extended Term”) following the Effective Date. Provided, however, after the Initial Term, either Consultant or the Company will be entitled to terminate the engagement at any time and for any reason, with or without cause prior to the expiration of this Agreement. Any contrary representations which may have been made to Consultant are superseded by this Agreement. The nature of the engagement after the Initial Term may only be changed in an express written agreement signed by Consultant and a duly authorized officer of the Company.

A person holding such an appointment may apply for a Probationary or Continuing appointment if such a position is available. 15.2.3.1.1 For appointments made under Article 15. 2.3.1, Librarian Members shall automatically be awarded an equivalent period of seniority for each full or partial year spent in Term appointments and be eligible for benefits. 15.2.3.1.1.1 Seniority for Term Librarians is defined as the number of years or fractions thereof worked as a Term Librarian in all Term appointments. 15.2.3.1.2 If, at the expiration of the period of a Term Librarian Member's appointment, it becomes necessary to offer a subsequent full time term appointment, for which the Librarian Member has all the appropriate expertise and competence and provided that the Member’s performance is satisfactory no external candidate shall be appointed unless the Term Librarian Member has first been offered and has refused reappointment. 15.2.3.1.2.1 In order to meet the operational requirements of the University, all Librarian Members’ letters of offer will include a statement that the Member must respond by a required date to the offer, or formally request and have approved by the Employer an extension to the timeline to respond to the offer; otherwise the Employer retains the right to withdraw the offer. 15.2.3.1.3 A Librarian Member who holds a full-time Term appointment may request a break in continuous employment while retaining the right of first refusal specified in Article 15.

Term Appointment. (a) A term appointment shall be for a contractually limited period to afford institutional flexibility typically to address replacement, project-based work or in response to term-limited funding. It shall not carry any implication that the Instructor or Academic Assistant will be considered for further appointment, extension or renewal, unless provision for conversion as specified in Article 15.03.3 is made in the current letter of appointment. (b) A Term Appointment shall only be made under Article 15.03.3 or one of the conditions listed in Article 18.01.1(a) (with "Faculty Member" replaced with "Instructor/Academic Assistant", wherever this appears in Article 18.01.1(a). (c) Term appointments in consecutive Academic Years for which the assigned duties of the Member have not changed significantly will: (i) not exceed a cumulative period of appointment of six (6) years; (ii) be made at the same rank; and, (iii) be made at a salary of no less than the previous appointment. (d) Term appointments for less than a year shall be remunerated at the full-time salary rate for the term of the appointment when assigned duties are at the full-load equivalent. When consecutive term appointments result in a cumulative load of 0.5 full-load equivalent or greater for the Academic Year, the Member shall receive financial compensation in lieu of benefits. (e) Term appointees will be informed by the Xxxx at the earliest possible opportunity if there will be a recommendation to the Board to renew or extend the term appointment. Any renewals or extensions of term appointments under Article 15 shall be in accordance with the provisions of

It shall not carry any implication that the Faculty Member will be considered for a probationary appointment or an appointment with tenure unless special provision for conversion into a probationary appointment as specified in Article 18.01.3 is made in the original letter of appointment. Except for such provision as specified in Article 18.01.3, a term appointment shall not be made except under one or more of the following conditions: (i) That the appointment is a replacement for a Faculty Member on leave or on another assignment of duties. Normally, such an appointment will be limited to the term of the relevant leave or reassignment. However, there may be some circumstances where the term may require a start or end date beyond the term of the relevant leave or reassignment. (ii) That the appointment is of someone unqualified for continuing appointment because a person with the required qualifications is not available at the time. (iii) That the duties connected with the appointment are for a limited period and are expected to be no longer required after the specified date. (iv) That the appointment is caused by the sudden unforeseen departure of a Faculty Member. (v) That the appointment is to afford flexibility in program development as determined by the Vice-President (Academic). (vi) That the appointment is due to the circumstances specified in Article 17.03. (b) Consecutive term appointments for which the assigned duties of the Member have not changed will: (i) not exceed a cumulative period of appointment of six (6) years; (ii) be made at the same rank; and, (iii) be made at a salary no less than the previous appointment. (c) Term appointees will be informed by the Xxxx/ at the earliest possible opportunity if there will be a recommendation to the Board to renew the term appointment. (d) As part of a recommendation for a term appointment, the Xxxx will recommend to the Board the rank at which an appointment will be made.

A full-time term appointment which includes both the fall and winter semesters shall be a single continuous appointment. A term college professor who teaches 6.8 TLUs or more in consecutive fall and winter semesters shall receive a full-time salary for the two week period between the fall and winter semesters whether or not the employee’s initial offer(s) of appointment included this period. A term non-instructional employee who is employed for 1010 hours or more over consecutive fall and winter semesters shall receive a full-time salary for the two week period between the fall and winter semesters whether or not the employee’s initial offer(s) of appointment included this period.
