Common use of Term; Assignment Clause in Contracts

Term; Assignment. (a) For the purposes of this Article, term assignment shall mean when an existing full time employee either applies for or is appointed to a term assignment. (b) If the term assignment is expected to last twelve (12) months or more: (i) the Employer may use the Acting Pay provision, or if not; (ii) the Employer will post and fill in accordance with Article 13 of the Collective Agreement; (iii) if filled by an existing seniority employee, such employee shall be eligible to return to his/her former position at the expiry of the term of the assignment; (iv) if there are no qualified bargaining unit applicants, then the position can be filled with a temporary employee. (c) If the term assignment is expected to last less than twelve (12) months, the Employer shall first attempt to use the Acting Pay provision if the requirement is above the entrance level and an employee capable of performing the work is available. If such is not the case, the position may be filled with a temporary employee. (d) If a term assignment which is expected to last less than twelve (12) months exceeds the twelve (12) months and has not been filled on an Acting basis, a meeting/discussion shall take place between the Human Resources Department, the hiring department and the Union to determine whether or not the opening should now be posted.
