Common use of Termination of ACDBE Subcontractor Clause in Contracts

Termination of ACDBE Subcontractor. Concessionaire must not terminate for convenience an ACDBE Subcontractor and then perform the work of the terminated subcontract with its own forces or those of an affiliate without the Director of the Office of Business Opportunities prior written consent. When a ACDBE Subcontractor is terminated or fails to complete its work on Agreement for any reason, Concessionaire must notify the Director of the Office of Business Opportunities in writing prior to any such termination and must make good faith efforts to find another ACDBE Subcontractor to substitute for the original ACDBE. These good faith efforts shall be directed at finding another ACDBE to perform at least the same amount of work under Agreement as the ACDBE that was terminated, to the extent needed to meet the contract goal.
