Terms of Approval. Landlord shall respond to Tenant’s request for approval within fifteen (15) business days after receipt of the Transfer Notice. If Landlord approves the proposed Assignment or Sublease, Tenant may, not later than thirty (30) days thereafter, enter into the Assignment or Sublease with the proposed Transferee upon the terms and conditions set forth in the Transfer Notice.

Terms of Approval. Landlord shall respond to Tenant’s request for approval within fifteen (15) business days after receipt of the Transfer Notice, and if Landlord fails to respond within such fifteen (15) day period, Landlord shall be deemed to have disapproved such proposed Assignment or Sublease. If Landlord approves the proposed Assignment or Sublease, or if an Assignment or Sublease is permitted by operation of law, Tenant may, not later than thirty (30) days thereafter, enter into the Assignment or Sublease with the proposed Transferee upon the terms and conditions set forth in the Transfer Notice, and sixty percent (60%) of the Excess Rent received by Tenant shall be paid to Landlord as and when received by Tenant and forty percent (40%) of the Excess Rent received by Tenant shall be retained by Tenant. “Excess Rent” means the gross revenue received from the Transferee during the Sublease term or with respect to the Assignment, less (a) the gross revenue paid to Landlord by Tenant during the period of the Sublease term or during the Assignment; (b) any reasonably documented tenant improvement allowance or other economic concession (planning allowance, moving expenses, etc.), paid by Tenant to the Transferee or to a third party in connection with the transfer; (c) customary and reasonable external brokers’ commissions to the extent paid and documented; (d) reasonable attorneys’ fees; and (e) reasonable costs of advertising the space for Sublease or Assignment (collectively, “Transfer Costs”). Tenant shall not have to pay to Landlord any Excess Rent until Tenant has recovered its Transfer Costs.
Terms of Approval. The terms of approval are attached to this agreement and should be completed in line with each annual review. Changes to the approval status must only be made by the head of service, following recommendation from the appropriate panel. Allowances will be paid to the Xxxxxx Carer according to the skills of the carer and age of the child in accordance with Rochdale’s Fostering Service scale of allowances. If the Carer wishes to terminate the agreement, he/she must give written notice. The carer’s approval then terminates automatically 28 days after the Fostering Service receives the notice. If the Fostering Service wishes to terminate the agreement (i.e. by terminating the Xxxxxx Carer’s approval), it has to give him/her written notice of its proposal and the reasons for it. The Xxxxxx Carer then has 28 days to make any representations against the proposal. The Fostering Service cannot terminate their approval until either the 28 days have elapsed without the carer making any representations or the carer’s representations have been considered and the service still wants to terminate the approval. Xxxxxx Carers cannot be registered with any other Fostering Agency whilst part of Rochdale’s Fostering Service and must have either resigned or been de-registered prior to applying elsewhere, unless agreement has been reached between Rochdale’s Children’s Social Care Service and the new fostering service provider about arrangements for the continuing management of the placement.
