Common use of Terms of Employment and Duties Clause in Contracts

Terms of Employment and Duties. The Company agrees to employ you as its Executive Vice President and Chief Operating Officer for a period (the “Term”) of four years from December 23, 2002 (the “Start Date”), unless your employment is sooner terminated by you or the Company. You will devote your full business time and attention to your duties as Executive Vice President and Chief Operating Officer. You will report directly to the Chief Executive Officer and will comply with all reasonable instructions of the Chief Executive Officer.

Terms of Employment and Duties. The Company agrees to employ you as its Executive Vice President and Chief Operating Financial Officer for a period (the “Term”) of four years from December 23January 14, 2002 2003 (the “Start Date”), unless your employment is sooner terminated by you or the Company. You will devote your full business time and attention to your duties as Executive Vice President and Chief Operating Financial Officer. You will report directly to the Chief Executive Officer and will comply with all reasonable instructions of the Chief Executive Officer.

You will report directly to the Chief Executive Officer or another executive officer determined by the Chief Executive Officer and will comply with all reasonable instructions of the Chief Executive OfficerOfficer or other executive officer to whom you report.
