Common use of The Commission Clause in Contracts

The Commission. In the event that the steps contained in sub-clauses 2.5.1 -2.5.5 inclusive have been followed but there has been failure to resolve the dispute, a party to the dispute may apply to the Commission to have a dispute resolution process conducted by the Commission. The Commission may offer an alternative dispute resolution process as a procedure for the resolution of disputes, and includes one or several of the following: (a) conferencing; (b) mediation; (c) assisted negotiation; (d) neutral evaluation; (e) case appraisal; (f) conciliation; (g) arbitration, or other determination of the rights and obligations of the parties in dispute; and/or (h) a procedure or service specified in the regulations.
