THE DECREE IS EXPROPRIATORY. ‌ 71 Article 7(1) of the Ticadia-Kronos BIT states that "neither Contracting Party shall nationalize or expropriate a covered investment either directly or indirectly through measures having an effect equivalent to nationalization or expropriation" except under very specific conditions. Respondent violated this provision by implementing the expropriatory Decree, prohibiting the exploitation of lindoro in its entire territory and terminating the Agreement with no compensation to Claimant. 72 Respondent has passed the 2015 Kronian Environmental Act (hereinafter: KEA) on 12 June 2015. XXX inter alia vests the power in the Kronian President “to intervene in the conduct of environmentally sensitive business”. 83 On 7 September 2016 Respondent’s President issued the Decree, basing his power to do so on KEA.84 However, the KEA enactment procedure was unconstitutional and therefore it was not within President’s power to issue the Decree. 73 In order to protect Claimant from this unlawful and uncompensated expropriation, the Tribunal shall first, recognize that direct expropriation occurred on 14 September 2017 (1) and second, find that other measures adopted by Respondent led to a compensable indirect expropriation (2).

  • Expropriation 1. The investments of investors of a Contracting Party shall not, directly or indirectly, be nationalized, expropriated or subject, in any other way, to other measures having an effect equivalent to the nationalization or expropriation (hereinafter referred to as "expropriation") in the territory of the other Contracting Party, unless the following conditions are complied with:

  • Confiscation Students’ devices may be confiscated if the school has reasonable grounds to suspect that a device contains data which breaches the BYOD Student Agreement. Maintenance and support: Students are solely responsible for the maintenance and upkeep of their devices. Ergonomics: Students should ensure they are comfortable using their device during the school day particularly in relation to screen size, sturdy keyboard etc.

  • Nationalization and Expropriation 1) Investments of investors from one of the Contracting Parties shall not subject be to nationalization, expropriation, or any other measures of similar effect directly or indirectly in the territory of the other Contracting Party, unless it is for general purposes on a non-discriminatory basis and in exchange for the payment of actual and fair compensation in accordance with legal procedures and without unjustified delay.

  • Accidents and Dangerous Occurrences The Hirer must report all accidents involving injury to the public to a member of the Village Hall management committee as soon as possible and complete the relevant section in the Village Hall’s accident book. Any failure of equipment belonging to the Village Hall or brought in by the Hirer must also be reported as soon as possible. Certain types of accident or injury must be reported on a special form to the local authority. The Hall Secretary will give assistance in completing this form. This is in accordance with the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 (RIDDOR).

  • Nationalization or Expropriation 1. The investments to which this Agreement relates shall not be subject to any measure which might limit the right of ownership, possession, control or enjoyment of the investments, permanently or temporarily, save where specifically provided by current, national or local, legislation or regulations and orders handed down by Courts or Tribunals having jurisdiction.

  • Condemnation As of the date of origination and to the Mortgage Loan Seller’s knowledge as of the Cut-off Date, there is no proceeding pending and, to the Mortgage Loan Seller’s knowledge as of the date of origination and as of the Cut-off Date, there is no proceeding threatened for the total or partial condemnation of such Mortgaged Property that would have a material adverse effect on the value, use or operation of the Mortgaged Property.

  • No Annexation Any and all equipment placed on the premises of a Party shall be and remain the property of the Party providing such equipment regardless of the mode and manner of annexation or attachment to real property, unless otherwise mutually agreed by the Parties.

  • Fire Or Lightning 2. Windstorm Or Hail This peril includes loss to watercraft of all types and their trailers, furnishings, equipment, and outboard engines or motors, only while inside a fully enclosed building. This peril does not include loss to the property contained in a building caused by rain, snow, sleet, sand or dust unless the direct force of wind or hail damages the building causing an opening in a roof or wall and the rain, snow, sleet, sand or dust enters through this opening.

  • MULTIPLE TENANT OR OCCUPANT(S) Each individual that is considered a Tenant is jointly and individually liable for all of this Agreement's obligations, including but not limited to rent monies. If any Tenant, guest, or Occupant(s) violates this Agreement, the Tenant is considered to have violated this Agreement. Landlord’s requests and notices to the Tenant or any of the Occupant(s) of legal age constitutes notice to the Tenant. Notices and requests from the Tenant or any one of the Occupant(s) (including repair requests and entry permissions) constitutes notice from the Tenant. In eviction suits, the Tenant is considered the agent of the Premise for the service of process.

  • Illegal Dumping The Contractor shall ensure that it and all of its Subcontractors and assigns prevent illegal dumping of litter in accordance with Title 5, Texas Health and Safety Code, Chapter 365.
