The said Smt. Xxxxxx Xxxxxx Xxxxx died intestate on 10th February 2002 leaving her surviving her son, the said Xxxxxxxx Xxxxxxx Xxxxx as her only heir and legal representative who upon her death inherited and became entitled to, amongst other properties, the entirety of the Project Land, absolutely.
The said Smt. Xxxxxxx Xxx, Xxx Xxxxxx Xxx, Xxx Xxxx Xxxxx Xxx, Smt. Xxxxxxx Xxxxxx @ Smt. Xxxx Xxx, Smt.
The said Smt. Xxxxxxx Xxx who during her lifetime was a Hindu and governed by the Dayabhaga School of Hindu Law died intestate on 6th February, 2005 leaving behind her surviving her three daughters Xxx. Xxxx Xxx, Smt. Xxxxxx Xxx and Smt. Xxxxxxx Xxx and five sons namely Xxxxxxxxxx Xxx, Xxxxxxx Xxx, Xxxxx Xxx, Xxx Xxxxxxx Xxx alias Xxxxxxx Xxx and Xxxxxx Xxx as her heirs, heiresses and legal representative who upon her death jointly inherited All That her undivided share in the said land.
The said Smt. A and Smt. B include their respective legal heirs, successors and legal representatives.
The said Smt. Xxx Xxxxxx Xxxx, being the Executrix to the said Last Will and Testament of the said Xxx Xxxxxx alias Xxx Xxxxxx Xxxxxxx, since deceased filed an application being No. 65 of 1980, in the Hon’ble High Court, Calcutta, for grant of the Probate of the last Will and Testament of the said Xxx Xxxxxx alias Xxx Xxxxxx Xxxxxxx, since deceased.
The said Smt. Debjani Biswas (NRI) as Owner has executed and registered a Development Agreement on 25.08.2015 in respect of her share in the said property mentioned in SCHEDULE-“A” hereunder in favour of the Promoter- Muskan Highrise Private Limited. The said Development Agreement was registered at the office of Additional District Sub Registrar at Alipore and entered in Book No. I, C.D. Volume No. 1605-2015 Page Nos. 60238 to 60270, Being No. 160505949 for the year 2015.
The said Smt. Xxxxxxx Xxx Xxxxx (alias Xxxx Xxx Xxxxx) daughter of late Xxxxxx Xxxxxx Xxx Xxxxx while seized and possessed of her undivided 1/4th share in the said property died intestate on 26.06.2011 leaving behind her surviving her only son

The said Smt. Xxxxxxxxx Xxxxxx wife of Late Xxxxx Xxxxxx Alias Xxxxx Xxxx Mondal, & Xxx. Xxxxxxx Xxxxxx & Sri. Xxxxx Xxxxxx both sons of Late Xxxxx Xxxxxx Alias Xxxxx Xxxx Mondal (herein after referred as the landowners No. 3) became the absolute owner of the said Land admeasuring 05 Kata – 07 Chittack- 00 Sq.ft., “BASTU” in nature comprised in R.S. & L.R. Dag No. 227, R.S Khatian No. 214 situated at Mouza- Raghunathpur, X.X. Xx.08, R.S. No. 134, Touzi No. 3072 under P.S.- Rajarhat, Presently Baguiati, District North 24 Parganas, West Bengal presently under jurisdiction of Bidhannagar Municipal Corporation, Xxxx Xx. 0, Xxxxxxxx, Xxxxxxx 000000, accordingly the said land owners has also mutated their name in the record of Bidhannagar Municipal Corporation and having the Holding No. 334 of their aforesaid land, and the said landowners has also recorded and mutated their name in the X.X & L.R.O, Xxxxxxxx under L.R. Khatian No. 3020, 3021, 3022, after that they are paying all the taxes accordingly without any default and enjoying their land peacefully and free from all encumbrances.
