Timing of payments and subsequent phases. Without limiting the foregoing, FCM shall pay impact and permit fees at the time of building permit issuance based on the phase of the Project sought to be built at the time as described in the application for building permit and approved plans (except as otherwise provided in subparagraphs 25(a) and (b) above). Impact and permit fees for subsequent phases of the Project shall be in accordance with the City Code at the time of building permit issuance under the applicable category. City water and wastewater impact fees will be due at the time of processing of a commercial service application for the installation of water meter(s) for the Project. It is understood and agreed to by the parties that City water and wastewater impact fees are based on projected engineer’s estimates and actual water (potable and reuse) and wastewater usage for the Project may differ-as such, the parties agree that a “true-up” based on actual average usage based on the average consumption of the first twelve (12) months after the Advanced Manufacturing Facility is placed into service will be made. In the event such true-up reflects a lower usage than as calculated no reimbursement shall be provided, In the event such true-up reflects a higher usage than as calculated, then FCM shall pay the City such applicable difference. Such true-up shall take into account the use of reuse water in lieu of potable water.

  • Timing of Payments All payments of Expenses (including without limitation Expense Advances) by the Company to the Indemnitee pursuant to this Agreement shall be made to the fullest extent permitted by law as soon as practicable after written demand by Indemnitee therefor is presented to the Company, but in no event later than thirty (30) business days after such written demand by Indemnitee is presented to the Company, except in the case of Expense Advances, which shall be made no later than ten (10) business days after such written demand by Indemnitee is presented to the Company.
