Title Policy Delivery Condition. A condition of School's obligations under the terms of this Lease is that Landlord must provide, at Landlord's expense, the Title Policy (subject only to the Permitted Exceptions), effective on or immediately prior to the Term Commencement Date ("Title Policy Delivery Condition"). If the Title Policy Delivery Condition is not satisfied or waived by School, School shall have the right to terminate this Lease prior to the Rent Commencement Date, if Landlord does not deliver the Title Policy, and in such event Landlord shall return to School the Prepaid Rent, Security Deposit, all payments for Change Orders, and all other amounts advanced by School.
