Toters. Notwithstanding anything to the contrary contained in the Agreement, beginning January 1st, 2021, Contractor shall offer residents of the Village with a 95 gallon tote for solid waste (a “Toter”), and a 65 gallon tote for recycling (a “Toter”). Contractor shall retain title and ownership to the Totes, provided, however, contractor shall not be liable for damage to Toters caused by the negligence or willful misconduct of the residents of the Village. Contractor shall retain title and ownership of the Toters following the termination of the Agreement.

Toters. The Township Contracted Hauler shall exercise reasonable care in handling toters and bags and shall not willfully break, deface, or injury the same. All toters that are broken or destroyed by improper or careless handling by the Township Contracted Hauler shall be replaced at its sole expense within forty-eight hours.
Toters. Receptacle carts provided by Groot of 35-gallon, 65-gallon, and 95-gallon capacity with attached lids and approved by the Village. Such Toters shall be optional receptacles for disposal of Refuse and Recyclables and shall be subject to a lease rate agreed upon by both Groot and the Village.
