TOWN’s Obligations Limited. The TOWN’s obligation under this Article is expressly limited for the TOWN, its officers, officials, employees and agents pursuant to Section 5-301, et seq., of the Courts and Judicial Proceedings Article of the Annotated Code of Maryland, as from time to time amended, and such additional amounts as may be specifically appropriated by the TOWN in discharge of the TOWN’s obligations under this Section.

TOWN’s Obligations Limited. Except as otherwise expressly herein provided, no recourse under or upon any obligation or agreement contained in this Lease Agreement or under any judgment obtained against the Town, or by the enforcement of any assessment or by any legal or equitable proceeding by virtue of any constitution or statute or otherwise or under any circumstances, under or independent of the Contract, shall be had against the Town. Anything in this Lease Agreement to the contrary notwithstanding, it is expressly understood and agreed by the parties hereto that (a) the Town may rely conclusively on the truth and accuracy of any certificate, opinion, notice or other instrument furnished to the Town by the Bank or the YMCA as to the existence of any fact or state of affairs required hereunder to be noticed to the Town; (b) the Town shall not be under any obligation hereunder to perform any record-keeping or to provide any legal services, it being understood that such services shall be performed either by the Bank or the YMCA: and (c) none of the provisions of this Lease Agreement shall require the Town to expend or risk its own funds or to otherwise incur financial liability in the performance of any of its duties or in the exercise of any of its rights or powers hereunder, unless it shall firs t have been adequately indemnified to its satisfaction against the cost, expenses and liability which may be incurred thereby. Notwiths tanding anythi ng herein con tained to the contr ary, any obligation which the Town may incur under this Lease Agreement or under any instrument executed in connection herewith which shall entail the expenditure of money shall not be a gener al obligation of the Town but shall be a limited obligation payable solely from the Rental Payments.
