University’s Obligations. The University agrees and undertakes or agrees to procure that the Managing Agent does so: 4.1 To provide the Services, subject to the terms in the Resident’s Handbook. 4.2 To provide the items in the inventory at the start of the Period of Residence and provided the Student has reported such items to the Managing Agent to repair or replace any damage or missing item which was not caused by the Student or their visitor(s). 4.3 To use reasonable endeavours to give the Student at least 48 hours’ notice prior to entering the Accommodation during term-time for planned maintenance work provided that no notice will be given in the case of an emergency, for disrepair reported by the Student, for matters relating to health and safety or any other matter affecting the suitability of the Accommodation for habitation. For other purposes, and for planned maintenance outside term-time, the University will aim to give the Student at least 24 hours’ notice. 4.4 Not to interrupt the Student’s occupation of the Accommodation more than is reasonably necessary, particularly during examination periods and to use reasonable endeavours to ensure that the Managing Agent does not do so. 4.5 Not to disclose personal information obtained from the Student except as permitted by clause 7 of this agreement or where there is serious risk of harm to the Student, to others, or to the University’s or another person’s property and to use reasonable endeavours to ensure that the Managing Agent does not do so. 4.6 Before the end of the first week of the Period of Residence to provide, or to use reasonable endeavours to ensure that the Managing Agent provides, the Student with information and advice on: 4.6.1 action to be taken in the event of an emergency, including emergency contact details, how to call an ambulance, where to get first aid, and how to report an accident or safety defect; 4.6.2 health & safety matters such as how to avoid common fire risks; safe cooking in the designated areas of the Residence and why cooking in bedrooms is a safety risk and in breach of this agreement; electrical safety and voltage differences; the dangers of using candles or other naked flames or storing flammable material; fire extinguishers; the possibility of disciplinary action or criminal proceedings for mis-use of fire precautions equipment; 4.6.3 how to get access to the Accommodation in the event of the Student losing their keys; 4.6.4 cleaning schedules and students’ responsibilities for cleaning;...

The University will provide an administrative framework, including designating a University faculty or other representatives to coordinate scheduling, provide course information and objectives, and assist in advising students. 4.2. The University will be responsible for developing and carrying out procedures for student selection and admission. 4.3. The University is responsible for the negligent acts and omissions of its employees and agents and maintains insurance coverage through the State of Arizona’s Risk Management Division self-insurance program to cover liabilities arising from the acts and omissions of the University’s employees, students, and agents participating under this Agreement, except as provided for in Arizona law, including Arizona Revised Statutes (ARS) ARS §12-820.05 and 41-621(L). The University is not responsible for maintaining insurance coverage for liability arising from the acts and omissions of the Facility’s employees and agents. Upon written request, University will furnish Facility with reasonable documentation evidencing compliance with this section.

No notice will be given in the case of an emergency, for disrepair reported by the Student, for matters relating to health and safety, the prevention or detection of crime, or any matter affecting the suitability of the Accommodation for habitation. For other purposes, and for planned maintenance outside term- time, the University will aim to give the Student at least 24 hours’ notice. 2.5 Not to interrupt the Student’s occupation of the Accommodation more than is reasonably necessary, particularly during examination periods. 2.6 Not to disclose personal information obtained from the Student except as permitted by clause 3.3 of these terms and conditions or where there is serious risk of harm to the Student, to others, or to the University’s or other people’s property or previous written consent has been received. 2.7 To make available for inspection by prior arrangement, the University’s: (a) Risk register for critical risks such as fire, outbreak of disease, or major disrepair and the University’s procedures for dealing with such risks; (b) Portable Appliance Testing (XXX) policy; (c) Log of visits to the Accommodation, whilst unoccupied, by University staff and contractors during term- time, giving the reason for access; (d) Fault reporting and emergency procedures for use of the University’s laundry facilities; (e) Planning and building regulations consents (if any) applicable to the Residence; (f) The Universities UK Code of Practice for the Management of Student Housing; (g) The University’s transport policy; (h) The University’s security plan; (i) The University’s service level statement on reporting and rectification of building defects. 2.8 Before the end of the first week of the Tenancy Period the University will provide the Student with information and advice on: (a) action to be ...

University’s Obligations. During the Residential Year, the University agrees to be bound by the provisions of this clause 6: 6.1 will in accordance with the terms of this Licence Agreement allow to occupy an allocated or temporary Room and Communal Areas for the Licence term as provided for in clause 2. 6.2 to give reasonable notice (save in the case of emergency where no notice is necessary, for example flooding or an electrical fault), to You of the intention of the University or its agents or contractors to enter the Room in order to inspect the condition of the Room and the contents and to carry out repairs as appropriate. 6.3 the University may in its absolute discretion enter the Room and confiscate any article which in its reasonable opinion presents a risk to the health and safety to You or other residents and /or staff of the University and should not be within the Room. The article will then either be handed over to the police or retained by the University, at Your expense, until collected by You and removed from University grounds. If at the end of the Licence Agreement You have still not collected the article, the University will give You 14 days’ notice to retrieve the article and if unclaimed after such period, the University reserves the right to dispose of it. The reasonable disposal costs incurred by the University may be reclaimed from You. 6.4 If the University’s provision of energy and utilities, which is included as part of the Licence Fee, is affected by an event outside our control then the University will contact You as soon as possible to let You know and the University will take steps to minimise the effect of the disruption. Provided the University does this, the University will not be liable for delays caused by the event but if there is a risk of substantial disruption of a duration of more than three calendar months, You may contact us to end the Licence Agreement and receive a refund for the proportion of the remaining Licence Agreement. 6.5 If You have any questions or complaints about the services provided to You by the University under this Licence Agreement, please contact your local Facilities Information Hub in the first instance.
