Transfer of Long Term Management Responsibilities. The Sponsor may assign its long term management responsibilities to a third party assignee, which will then serve as Long Term Xxxxxxx in place of the Sponsor. The identity of the assignee and the terms of the long term management and maintenance agreement between the Sponsor and the assignee must be approved by the Corps and Ecology, following consultation with the IRT, in advance of assignment. Upon execution of a long term management assignment agreement and the transfer of the contents of the Long Term Management Account, and upon satisfaction of the remaining requirements for termination of the Establishment Phase of the ILF Program under Article V.I., Mitigation Site Operational Phases, the Sponsor shall be relieved of all further long term management responsibilities under this Instrument which are associated with the site for which responsibilities have been transferred.

RESPONSIBILITIES OF THE CORPS AND ECOLOGY AS CO-CHAIRS OF THE 755 IRT 756 A. The Corps and Ecology agree to provide appropriate oversight in carrying out 757 their responsibilities under the provisions of this Instrument.

  • Department Responsibilities The use of sick leave may properly be denied if these procedures are not followed. Abuse of sick leave on the part of the employee is cause for disciplinary action. The department may require medical verification for an absence of three (3) or more working days. The department may also require medical verification for absences of less than three (3) working days for probable cause if the employee had been notified in advance in writing that such verification was necessary. Agency shall, at its own expense, maintain operate, and provide power as needed upon Project completion at a minimum level that is consistent with normal depreciation and/or service demand and throughout the useful life of the Project. The useful life of the Project is defined in the Special Provisions. State may conduct periodic inspections during the life of the Project to verify that the Project is properly maintained and continues to serve the purpose for which federal funds were provided. Maintenance and power responsibilities shall survive any termination of the Project Agreement. In the event the Project will include or affect a state highway, this provision does not address maintenance of that state highway.
