Common use of Transfer Outside Bargaining Unit Clause in Contracts

Transfer Outside Bargaining Unit. (a) An employee who transferred to a position not subject to the terms of this agreement shall retain his/her seniority up to thirty (30) days after the date of transfer to the position outside this Agreement. If he/she is transferred back to the bargaining unit, seniority will continue from the date of transfer back to this bargaining unit.

(a) An When an employee who is permanently transferred or promoted to a position not subject to the terms of this agreement shall retain his/her seniority up to thirty (30) days after the date of transfer to the position outside this Agreement. If he/she is transferred back to the bargaining unit, he will retain his bargaining unit seniority will and continue to accumulate seniority under this Agreement for a period of twelve (12) months from the date of such transfer back to or promotion. After such twelve (12) month period, the employee shall have no accumulated seniority under this bargaining unitAgreement.
