Vacancy and Transfer.
A. No matter the time of year, except in August, the Board shall provide every teacher a notice of all vacancies and newly created positions via the teachers’ school electronic mail. There shall be no less than a five (5) working day posting period when the administration determines that a job opening exists, which it intends to fill, within the bargaining unit.
B. Final determination in all transfer actions is the responsibility of the Superintendent.
C. If a request for transfer is denied, the Superintendent will notify the employee via email of the reasons for denying the request. If the employee so requests, within seven (7) work days of the date of the written notice, a meeting between the Superintendent and said employee shall be held prior to final action. The District agrees to give notices on the date so noted in the written notice.
D. Involuntary transfers may be made in accordance with Section F herein. In such cases, the Superintendent will notify the employee in writing of the reasons for the transfer. If the employee so requests, within seven

A vacancy in a teaching position shall exist whenever the Board determines that a position is unoccupied and that there is no incumbent employee who has the right to the assignment. Vacancies may occur by the creation of a new position or by the resignation, retirement, transfer, leave of absence, death or long term illness of the teacher holding the assignment. Vacancies that occur during the school year may be filled without posting at the discretion of the Board, but must be posted before the following school year.
Vacancy and Transfer. 1. For the purposes of this section, a bona fide vacancy is defined as occurring once a bargaining unit position becomes open to be filled with a probationary appointment.
2. When a vacancy exists, the District shall inform the President of ASAR in writing and post the vacancy in the district’s weekly electronic bulletin.
3. All vacancies for bargaining unit positions including assignments to summer school positions shall be posted for five (5) business days unless the position will be filled with an acting assignment. The intent to fill the position on an acting basis shall be communicated to the President of ASAR by the Superintendent or his/her designee in advance of making the acting assignment.
4. Applications for unit positions shall be screened by the Department of Human Capital Initiatives to establish if the applicant meets minimum qualifications contained in the posting. Applications of qualified candidates will then be sent to the appropriate supervisor for additional screening and interviewing.
5. To be considered for a lateral transfer to a posted vacancy, a Unit member must indicate his or her interest, in writing, to the Chief of Human Capital Initiatives by 4:00 p.m. of the fifth business day of the week that the vacancy was posted.
6. During the period between July 1 and the first day of the April recess, any Unit member may submit a promotional application for a specific position at any location, an identified number of locations, or a specific location.
7. The District will announce annually that it is accepting promotional applications for titles when openings occur through the year.
8. Paragraphs 6 and 7 do not restrict the District from advertising for a particular position or title at any time. All Unit members are eligible to apply as a result of such advertising.
9. When a principal has given written notice to terminate employment with the District, or the District has created a new principalship, or the District has taken action to create an opening in a principalship, all principals in that level (elementary or secondary) shall be informed of the opening and be given an opportunity to request a transfer. The principals will be given five working days from the time the notice is mailed to respond in writing to the Superintendent. The transfer request is confidential and shall not be discussed beyond the Superintendent and his or her direct reports, unless the Superintendent decides to approve the transfer request.

Vacancy and Transfer. A vacancy is defined as an opening for an Employee to be added or hired into a classification as determined by the Employer. Employees in the Bargaining Unit shall be notified of vacancies for which they may apply by posting a notice of such vacancy on the Employee bulletin board for a period of five (5) work days. The notice shall set forth a deadline for application. Employees may submit applications for the vacancy during the posting period. Selection shall be made from all applicants for the vacancy both internal and external. The most senior Employee applicant with qualifications equal to or better than the other applicants shall be rewarded the vacancy. Otherwise, the Employer reserves the right to choose the applicant who, in its judgment, is best qualified for the vacancy. All Employees reclassified will receive no less than prior classification wage unless Employee bids on lower wage classification. Any new hire or reclassified employees shall receive written notice of their classification including their rate of pay, scheduled work days and hours, and a copy of their job description. When a substitute is hired in a new position, the district and association will agree upon the continuance of the substitute beyond 45 days or the position will be posted.

Vacancy and Transfer. 14.1 Defining a Vacancy A vacancy shall be defined as a new position or a position not already filled by employee movement within a building. Vacancies will be filled by displaced employees or volunteers in the involuntary transfer pool before being opened to out-of-district and in-district applicants.
Vacancy and Transfer. A. A vacancy shall be defined for purposes of this agreement as a position presently unfilled, a position currently filled but which will be open in the future, or a new position that is currently not in existence.
Vacancy and Transfer. 1. When vacancies occur as the result of a retirement, resignation, an employee moving from one position to another, termination, contract non-renewal or other reasons and the Board/Administration determines to fill the vacancy, qualified staff members currently in the District’s employ will be given preference over outside applicants.
2. Notice of certificated vacancies and newly created positions shall be announced by email and phone call. The format will include date, job title, location of the vacancy, pay range, and anticipated starting date. Teachers desiring the announced positions have five (5) days from the date of the announcement to indicate their interest to the administration. A change from full-time to part-time status, and vice versa, shall not be considered a vacancy.
3. No bargaining unit member shall be involuntarily transferred or reassigned except for good reasons. Said reasons shall be given in writing to any bargaining unit member involuntarily transferred or reassigned.
Vacancy and Transfer. 9.1 Vacancy
1. Whenever a permanent vacancy within the bargaining unit arises during the school year, the Employer will post/email the vacancy electronically for a period of five (5) workdays. A copy of the posting will be sent to the Association president. Applicants must apply in writing to the Human Resources office within the posted period and must include the applicant's qualifications for the vacancy.
2. The Board or designee will redistribute unassigned duties to bargaining unit employees within the building as needed.
3. A unit member not assigned to a vacancy for which they have made application may request a meeting with administration to discuss the decision.
4. In filling vacancies, preference will be given to applicants within the same classification, based on the applicant's ability to meet the qualifications of the position as established by the Board, seniority and an interview process when applicable. When there are no qualified applicants within the same classification, the Board will fill the vacancy from qualified applicants from other classifications. In the event the vacancy remains unfilled, persons on recall will be notified of the vacancy and if qualified will receive consideration over any outside applicants.
5. Employees placed in a new classification shall have a trial period of thirty (30) days worked. The thirty (30) days worked may be extended for absences of the employee during that period by the number of absences. If the Board determines the employee has not successfully completed the trial period, the employee shall return to a comparable position in time only based on seniority within the employee’s previous classification and, if available, building/work area vacated. It is understood that the decision to return rests solely with the Board.
6. In an effort to streamline the filling of vacancies, while at the same time allowing for trial periods in a new classification, it is agreed:
1. In the event a posted position is vacated within thirty (30) days of its award through the post/bid process, and, another employee has bid on the same position, the vacated position will be awarded to the eligible bidder with the next highest seniority.
2. Positions vacated after a period of thirty (30) days, shall be reposted for bidding.
7. Changes in the hours assigned to an employee shall not be considered a vacancy under the terms and conditions of this Article.
Vacancy and Transfer. Whenever a vacancy in an ESP position occurs, a notice shall be posted on regular posting bulletin boards in each building in the District, and an email notification shall be sent to all District ESPs. Vacancies will be posted online. The District will endeavor, when filling vacancies, to secure a fully qualified individual who is suitable to the Board to fill a vacancy. Substitutes may be used before a vacancy is permanently filled. An employee assigned involuntarily to a new position will be provided appropriate training if necessary to perform duties assigned. When a paraprofessional ESP or custodian ESP is permanently involuntarily transferred to a new building, such employee shall be entitled to a five hundred dollar ($500) stipend to be paid within thirty (30) days of the conclusion of the first complete semester of assignment. In the event of an involuntary transfer, an ESP will be granted a meeting upon request with the appropriate Administrator and may also request an Association representative be in attendance. Permanent transfer is a transfer which administration intends to last one semester or more.
