Trespasser. In consideration of the services of GPNY, their agents, owners, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf I, an adult participant, Parent or Legal Guardian (parent, authorized adult, and guardian being referred to in this document as “Parent”) of a minor participant (for myself and on behalf of that minor participant) understand, acknowledge and agree as follows:

Trespasser. A person on railway property and whether intentionally or negligently, is in a place they have no right or authority to be or for the purpose of carrying out illegal activities. Includes: • Suspected suicide; • A person travelling in a place not authorised for their use, eg outside trains; • Stowaways; • A passenger or member of the public who uses without authority a recognised ‘staff only’ crossing (eg a staff foot crossing) at a station; • A person who acts in disobedience of warning signs or signals, or strayed away from the normal route of the level crossing; • A person crossing the track anywhere other than at an authorised crossing point; • People electrocuted while dangling or throwing objects from a position on non- railway property onto overhead line equipment/conductor rails at bridges etc; • A person who falls or jumps from a platform, unless it can be established that the person did not do it deliberately, eg a fall caused by illness, platform congestion etc, in which case they should be treated as a ‘passenger’, ‘employee’ or ‘public’. Excludes: • Employee; • Passenger; or • Public.
Trespasser. A person who is on (school) property without approval or permission. Trafficking Assisting in any manner with the distributing of a controlled drug or substance, as set out in the Controlled Drugs and Substances Act, or with the distributing of weapons.

  • Trespass PURCHASER shall be exclusively responsible for any damage or removal of non- designated timber, or trespass beyond the boundaries of the areas of operations resulting from any activities of PURCHASER. Any trespass resulting from the activities of PURCHASER may be considered grounds for placing the contract in violation or default. Damages for any trespass shall be charged as follows:

  • Defendant’s Breach of Plea Agreement If the defendant commits any crimes, violates any conditions of release, or violates any term of this plea agreement between the signing of this plea agreement and the date of sentencing, or fails to appear for sentencing, or if the defendant provides information to the Probation Office or the Court that is intentionally misleading, incomplete, or untruthful, or otherwise breaches this plea agreement, the United States will be released from its obligations under this agreement. The defendant, however, will remain bound by the terms of the agreement, and will not be allowed to withdraw his plea of guilty. The defendant also understands and agrees that in the event he violates this plea agreement, all statements made by him to law enforcement agents subsequent to the execution of this plea agreement, any testimony given by him before a grand jury or any tribunal or any leads from such statements or testimony shall be admissible against him in any and all criminal proceedings. The defendant waives any rights that he might assert under the United States Constitution, any statute, Rule 11(f) of the Federal Rules of Criminal Procedure, Rule 410 of the Federal Rules of Evidence, or any other federal rule that pertains to the admissibility of any statements made by him subsequent to this plea agreement.

  • DEFAMATION The Parties covenant and agree that in no event, and at no time during the Term or at any time thereafter, shall either of them disparage, denigrate, slander, libel or otherwise defame the other or the other’s businesses, services, properties or assets, or employees, personnel, agents, or representatives.

  • EVICTIONS The Owner hereby gives power to the Agent to sign and serve notices on the Owner’s behalf and prosecute actions to evict tenants; recover possession of the Property; recover rents and other sums due; and, when expedient, settle, compromise and release claims, actions, and suits and/or reinstate tenancies.

  • Assaults An employee who is assaulted while in the performance of assigned duties shall promptly report the assault to the Employer. The Employer shall promptly investigate the incident and render such assistance as necessary under the circumstances, including reporting and cooperating with law enforcement authorities.

  • Breach of Lease 4.H If the Academy Trust is, or if it is reasonably foreseeable that it will be, in material breach of the Lease, the Academy Trust must immediately give written notice to the Secretary of State stating what the breach is and what action the Academy Trust has taken or proposes to take to remedy it, including timescales where appropriate.

  • No Harassment Contractor does not engage in unlawful harassment, including sexual harassment, with respect to any persons with whom Contractor may interact in the performance of this Agreement, and Contractor takes all reasonable steps to prevent harassment from occurring.

  • Breach of Covenants If the Company breaches any of the covenants set forth in this Section 4, and in addition to any other remedies available to the Buyer pursuant to this Agreement, it will be considered an event of default under Section 3.4 of the Note.
