EVICTIONS. The Owner hereby gives power to the Agent to sign and serve notices on the Owner’s behalf and prosecute actions to evict tenants; recover possession of the Property; recover rents and other sums due; and, when expedient, settle, compromise and release claims, actions, and suits and/or reinstate tenancies.
EVICTIONS. From time to time, if and when a tenant defaults on their lease, and it becomes necessary for the landlord (Owner) to evict said tenant, Owner will be responsible for attorney’s fees and court costs when the eviction action includes a counter-claim against Owner or Broker (except if Broker is found to be grossly negligent, or have engaged in any willful misconduct, fraud, or breach of this Agreement as determined by applicable law), when the eviction action is for “Holding Over Beyond the Termination of the Lease,” or when the tenant files for bankruptcy protection. In all instances, Owner will be responsible for any reasonable expenses to remove the tenant from the Property, if applicable. Owner authorizes Broker to file dispossessory actions against tenants when, in Broker’s reasonable opinion, it is in Owner’s best interests to do so without first receiving Owner’s approval, unless otherwise directed by Owner; provided, however, that Broker shall provide Owner with 5 business days’ prior written notice of its intent to file any such dispossessory action against a tenant
EVICTIONS. Each eviction proceeding relating to an REO Property has been properly commenced and Seller is not aware of any valid defense or counterclaim by anyone with respect thereto. The REO Property, with respect to maintenance and service performed by Seller, has been serviced and maintained in compliance with all material laws and regulations.
EVICTIONS. Although All In Movers retains the right to cancel, and All In Movers may refuse to complete, an order for Services in the event that you or someone else at the location to be serviced is being evicted, in the event that an order for Services is nonetheless completed, you will not be eligible for any protection under the Damage Protection Policy and agree to indemnify, defend, and hold All In Movers and its subsidiaries and affiliates harmless from and against any and all expenses, losses, costs, (including reasonable attorneys’ fees and costs), judgments, settlements, damages, awards, interests, fines, and liabilities of whatever kind that All In Movers and/or its subsidiaries or affiliates may incur as a result of, arising out of, or in relation to your or someone else’s eviction.
EVICTIONS. Any law enforcement officer shall have a right, at any time, to enter the facility, parking area and the park to insure the provisions of the rental agreement are being met. Any person(s) or organization asked by law enforcement to leave the facility during their event because of a violation of the general rules, or of the City of Coquille Municipal Code, shall forfeit their rental fee and deposit.
EVICTIONS. Being evicted is a serious matter. The following items are some of the actions that can cause you to be evicted for “Material Non-Compliance” and/or “Other Good Cause” as stated in your lease agreement: • Inability to take proper care of your home. • Becoming a danger to health, safety or morals of yourself, your neighbors, the staff or the complex. • Distributing the peace of your neighbors. • Causing damage to your home or any other community property. • Maintaining your home in an unsanitary condition. • Subletting the home or allowing unauthorized people live in your home. • Non-payment of rent. • Non-payment of maintenance services charges when billed. • Any act or threat of violence to the employees of the property as well as to any other person of the property. • Possession of illegal drugs in your home or anywhere on or around the property, and/or use of such drugs and/or purchase or sale of such drugs from your home or anywhere on or around the property, by yourself, family and/or guest. • Repeated police calls to your home or the property due to activities of yourself, your family and/or guests. • Any actions by you, your family and/or your guest which result in police raid at the property. • Having pets without office authorization and a monthly pet fee. You must notify the office of any pets. • Flagrant and/or continued violation of any portion of your lease including rules in this Section.
EVICTIONS. If an employee is terminated or evicted you will have until 4:00pm to move out of Employee Housing and may be served with a No Trespassing for dorms or all of Sun Valley’s properties. This will depend on the circumstance of why the resident is being evicted. You will not be allowed to return to the dorms unless approved by all members of the dorm committee.
EVICTIONS. In the event of non-payment, or due to other reasons, Xxxxx Street may serve any and all applicable legal notices upon Tenants and to prosecute legal actions to terminate tenancies, evict Tenants and recover rents and any other sums due, and when necessary employing for these purposes a reputable attorney at Owner’s expense. EVICTIONS. In order to protect you, your fellow guest and the property we reserve the right to evict and notify appropriate authorities. If there is balcony climbing, in any form, throwing pitching or tossing objects from balcony at condos, possession or use of a fire arm, illegal narcotics, tampering with fire/burglar alarm equipment and devices, stolen credit card, false ID’s, underage consumption of alcoholic beverages on property, contributing to the delinquency of minors including but not limited to underage drinking on property, possession of kegs on subject property, jumping or rough play in elevators, malicious destruction or theft or damage of any property, indecent exposure, physical altercations, noise complaints, continued violations of any terms of this agreement or any rules/regulations of the HOA/Development/Condo building you are staying in. EVICTIONS. When rent collection efforts prove unsuccessful, Agent will coordinate eviction of tenants (through a licensed attorney, if necessary). The process will include the posting of a notice to quit the premises and the filing of the relevant paperwork to initiate and complete a forcible entry and detainer action in a court of competent jurisdiction. Agent will also coordinate with law enforcement, if necessary, to remove an evicted tenant and that tenant’s possessions from the Managed Property.
