Truck Loading. 4.1. The West Truck Loading Facility shall be owned, operated and maintained by Service Provider. 4.2. Service Provider shall provide agreed upon truck loading and unloading services (“West Truck Loading Services”) to Service Recipient consistent with a prudent operator standard, excluding any loading and unloading services with respect to ethylene oxide. 4.3. Service Recipient’s employees shall abide by Service Provider’s environmental, health and safety policies, standards and practices while present at the West Truck Loading Facility. 4.4. The Parties shall agree a reasonable basis for determining the Service Recipient’s share of the fixed costs of West Truck Loading services, including loading and/or unloading movements and/or a loading and/or unloading time, and this shall form the basis of the Service Recipient’s capacity reservation. 4.5. The Parties shall discuss and agree operational details and procedures to assure compliance with applicable Environmental Laws. 4.6. Service Provider shall maintain a record of the Service Recipient trucks that Service Provider loads/unloads and this shall be included in the true up mechanism referred to in Section 4.7.1.3. 4.7. The service fee for West Truck Loading Services shall be determined as follows: 5
Truck Loading. Loading and Unloading of Baggage Cars or Over-the-Road Vans. Employees utilized in the loading or unloading of baggage cars or over-the-road vans, in conjunction with commercial, trade or industrial shows, road shows, sporting events, circuses, ice shows or other traveling attractions that use baggage cars or over-the-road vans for transporting equipment along with all related items and component parts which are used for or in relation to the presentation of such shows, events or attractions. Baggage cars or over-the-road vans shall be loaded or unloaded within a three (3) hour period from the employee’s reporting time. Any time worked in excess of three (3) hours shall be compensated for at the applicable hourly rate set out in the wage Section. In the event the Employer calls employees for the exclusive purpose of loading or unloading of baggage cars or over-the-road vans, such employees shall receive a minimum three (3) hour call and shall be compensated for additional hours at the applicable hourly rate. Local signatory Employers who own, rent, or lease vans, trucks, trailers, or television facility trucks who have other related businesses outside the greater Las Vegas area are exempted from the requirements of this Section. It is agreed that the “greater Las Vegas area” shall mean a 50 (fifty) mile radius, the center of which shall be the Las Vegas Convention and Visitor’s Authority, located at 0000 Xxxxxxxx Xxxx, Xxx Xxxxx, Xxxxxx, 00000, xx Xxxxx Xxxxxx, but said “greater Las Vegas area” shall not exceed the borders of the State of Nevada.

Truck Loading. Unloading — None included. · Electrical 1. Power — Electrical power needs will be satisfied with one 138 kV — 12.47 kV transformer from a new on-site substation. The transformer will be sized to handle the full load of the terminal. All electrical systems will be minimally designed in accordance with latest editions of NEC, IEEE, and ISA. Distribution will be from 12.47 kV pole lines to the substation / motor control center, then by 480 V / 4,160 V lines in cable trays on pipe racks to the pump pads. Battery backup will be provided for critical systems. One 2,000 kW generator will be provided for prolonged outages. Provisions for a second 2,000 kW generator will be included in the design. 2. Area Lighting — Lighting will be pole mounted floods along roads, at pump pads, on tanks, on docks and around buildings.

  • Loading RPMG shall schedule the loading and shipping of all outbound corn oil purchased hereunder, but all labor and equipment necessary to load trucks and rail cars and other associated costs shall be supplied and borne by Producer without charge to RPMG. Producer shall handle the corn oil in a good and workmanlike manner in accordance with RPMG’s written requirements and normal industry practice. Producer shall maintain the truck and rail loading facilities in safe operating condition in accordance with normal industry standards and shall visually inspect all trucks and rail cars to assure (i) cleanliness so as to avoid contamination, and (ii) that such trucks and railcars are in a condition suitable for transporting the corn oil. RPMG and RPMG’s agents shall have adequate access to the Ethanol Facility to load Producer’s corn oil on an industry standard basis that allows RPMG to economically market Producer’s corn oil. RPMG’s employees shall follow all reasonable safety rules and procedures promulgated by Producer and provided to RPMG reasonably in advance and in writing. Producer shall supply product description tags, certificates of analysis, bills of lading and/or material safety data sheets that are applicable to all shipments. In the event that Producer fails to provide the labor, equipment and facilities necessary to meet RPMG’s loading schedule, Producer shall be responsible for all costs and expenses, including without limitation actual demurrage and wait time, incurred by RPMG resulting from or arising in connection with Producer’s failure to do so.

  • Leave Loading The employer and the individual employee must have genuinely made the agreement without coercion or duress.

  • Pipelines Developer shall have no interest in the pipeline gathering system, which gathering system shall remain the sole property of Operator or its Affiliates and shall be maintained at their sole cost and expense.

  • One-Way Interconnection Trunks 2.3.1 Where the Parties use One-Way Interconnection Trunks for the delivery of traffic from Onvoy to Frontier, Onvoy, at Xxxxx’s own expense, shall: 2.3.1.1 provide its own facilities for delivery of the traffic to the technically feasible Point(s) of Interconnection on Frontier’s network in a LATA; and/or 2.3.1.2 obtain transport for delivery of the traffic to the technically feasible Point(s) of Interconnection on Frontier’s network in a LATA (a) from a third party, or, (b) if Frontier offers such transport pursuant to a Frontier access Tariff, from Frontier. 2.3.2 For each Tandem or End Office One-Way Interconnection Trunk group for delivery of traffic from Onvoy to Frontier with a utilization level of less than sixty percent (60%) for final trunk groups and eighty-five percent (85%) for high usage trunk groups, unless the Parties agree otherwise, Onvoy will promptly submit ASRs to disconnect a sufficient number of Interconnection Trunks to attain a utilization level of approximately sixty percent (60%) for all final trunk groups and eighty-five percent (85%) for all high usage trunk groups. In the event Onvoy fails to submit an ASR to disconnect One-Way Interconnection Trunks as required by this Section, Frontier may disconnect the excess Interconnection Trunks or bill (and Onvoy shall pay) for the excess Interconnection Trunks at the rates set forth in the Pricing Attachment. 2.3.3 Where the Parties use One-Way Interconnection Trunks for the delivery of traffic from Frontier to Onvoy, Frontier, at Frontier’s own expense, shall provide its own facilities for delivery of the traffic to the technically feasible Point(s) of Interconnection on Frontier’s network in a LATA.
