Unaccounted for Gas. (a) Notwithstanding any other provision of this Agreement, ActewAGL’s obligation under this Agreement to purchase a Quantity of UAG is subject to and only applies to the extent that ActewAGL has timely access to verified and sufficiently accurate data at each Receipt Point to be able to calculate the LG Quantity. (b) ActewAGL will calculate an LG Quantity on the basis of the available data at the time. (c) ActewAGL may update the LG Quantity at any time to reflect updated data for an LG Period. However, ActewAGL is not obliged to recalculate the LG Quantity for a LG Period once 12 months have elapsed since the end of that LG Period. (d) ActewAGL will purchase UAG equal to: (i) ActewAGL’s forward estimate of the LG Quantity for an LG Period; less (ii) the difference between the Quantities of UAG ActewAGL has previously purchased for any earlier LG Period and the LG Quantity for that LG Period. (e) ActewAGL will purchase UAG on a competitive commercial basis. This basis will be determined by ActewAGL, acting reasonably, and may include utilising a competitive open tender for the supply and/or haulage of Gas over any period, as reasonably determined by ActewAGL. (f) ActewAGL will recover all costs of purchasing UAG through the Reference Tariffs in accordance with the provisions of the Access Arrangement. (g) ActewAGL may, by notice, terminate its obligations under clause 9.4(a) and this clause 9.5 with effect from the date that parties other than ActewAGL assume the responsibility to purchase UAG in relation to the Network. Such termination may be subject to conditions reasonably required by ActewAGL and will not prejudice the right of ActewAGL to recover the cost of UAG in accordance with the Access Arrangement.

(i) LG Period means a period of this Agreementtime over which an LG Quantity is calculated, ActewAGL’s obligation under this Agreement to purchase being a period of not less than 12 Calendar Months;
(ii) LG Quantity means the Quantity of UAG Gas that is subject calculated as follows:
(A) the aggregate of the measured Quantities of Gas received into the Network at all Receipt Points; less
(B) the aggregate of measured Quantities of Gas Delivered on behalf of all Network Users to and only applies to Delivery Points; less
(C) any increase (or plus any decrease) in linepack in the extent Network (as determined by JGN, acting reasonably), over an LG Period, as calculated at least 6 Calendar Months after the end of that ActewAGL has timely access to verified and sufficiently accurate data at each Receipt Point to be able to calculate the LG Quantity.Period;

(c) JGN will calculate an LG Quantity on the basis of the available data at the time.

(de) ActewAGL JGN will purchase procure UAG equal to:
(i) ActewAGLJGN’s forward estimate of the LG Quantity for an LG Period; less
(ii) the difference between the Quantities of UAG ActewAGL JGN has previously purchased procured for any earlier LG Period and the LG Quantity for that LG Period.
(ef) ActewAGL JGN will purchase procure UAG on a competitive commercial basis. This basis will be determined by ActewAGL, JGN acting reasonably, and which may include (without limitation) any one or a combination of the following:
(i) utilising a competitive open tender for the supply and/or haulage of Gas over any period, as reasonably determined by ActewAGLJGN;
(ii) sourcing Gas directly from the Short Term Trading Market; and
(iii) JGN itself producing UAG, or procuring UAG from a Related Body Corporate.
(fg) ActewAGL JGN will recover all costs of purchasing procuring UAG through the Reference Tariffs in accordance with the provisions of the Access Arrangement, provided that if paragraph 9.5(f)(iii) applies, the costs will be no greater than the costs which would have applied if JGN had procured the UAG from a third party.
(gh) ActewAGL mayNotwithstanding any other provision of this Agreement, by notice, terminate its obligations JGN’s obligation under clause 9.4(a) and this clause 9.5 with effect from the date that parties other than ActewAGL assume the responsibility Agreement to purchase a Quantity of UAG in relation is subject to and only applies to the Network. Such termination may extent that JGN has timely access to verified and sufficiently accurate data at each Receipt Point to be subject able to conditions reasonably required by ActewAGL and will not prejudice calculate the right of ActewAGL to recover the cost of UAG in accordance with the Access ArrangementLG Quantity.
