Under s. 6(1) of the Civil Law of Guyana Ordinance, cap. 2 a person attains his majority on attaining twenty-one years of age. Moreover as already stated s. 3(B) cap. 2 states “the common law of the Colony shall be the common law of Eng- land”, and the age of twenty-one has been fixed as that at which an abso- lute and unlimited legal capacity to contract shall commence, and the law relating to infants' contracts is the common law as modified by the Infants Relief Act 1874, which is incorporated into our law as s. 3 of the Infancy Ordinance, cap. 39. So that, even though the Indian Labour Ordinance gives an immigrant the right to marry without the consent of his or her par- ents it does not make him an adult so as to make him liable in an action for any breach of promise of marriage. In the circumstances, I am of the opinion that the Indian Labour Ord- inance was passed for the benefit of immigrants and does not impose a lia- bility on an infant in the sense of making him liable in an action for breach of promise of marriage. In the circumstances the action is dismissed. Cost to the defendant fixed in the sum of $200.00 (two hundred dollars). Action dismissed. Solicitors:
