Unforeseen Circumstances. An employee is not in breach of any of these notice requirements if the employee’s failure to comply is caused by unforeseen or other compelling circumstances, including: (a) the birth occurring earlier than the expected date; or (b) the death of the mother of the child; or (c) the death of the employee’s spouse, or (d) the requirement that the employee accept earlier or later placement of the child, so long as, where a living child is born, the notice is given not later than two weeks after the birth.
